Iv wrote this 6 times now to Deere. Can you contact John Deere and see if they will buy back the tractor or give me another one? In the last 5 months I have not been able to use the tractor to make money. Iv lost thousands of dollars. Im stuck with a tractor im paying payments on and cant use or sell. Winter is coming and I need a working tractor. I have never heard of a manufacture that builds a product but lacks the proper tools to make warranty repairs. John Deere needs to do something to make this right.

It sounds like you are writing the Deere dealer, not DEERE, the manufacturer. Have you allowed the dealer to repair the tractor? Has the dealer tried to get it in for the repair? JD is not going to give you your money back or give you a new tractor because 2 axle seals leak, especially on a 3 year old tractor. Just make an appointment for the dealer to repair it and be done with it. Or, keep it and keep making payments on it.

Write your story down on paper (dates, contacts with dealer and what you recall was said, other history that you know to be right) and make copies to your dealer, John Deere corporate, your lawyer, and state business office. Include the list of who you are sending this to. Specifically ask for a warranty exchange of tractors to a new one. If the repair part needed to fix is known, include that too. If this type of letter has been done the 6 times you mentioned, then time to get a lawyer to take it up for you.

Phone calls can be dropped with no record, emails are a form of written record (useful if returned with a reply) so include quotes if informative in your written letter. A written letter likely has to be considered at corporate office and passed down to the area rep and the dealer.

Does your state have a Consumer Product Watchdog? Business licensing authority? At a minimum you have to go above the dealer at this point.

I have been writting deere directly. I gave up on dealer. They still say they cant find this magic tool to do the repair.

Iv been 5 months paying payments through john deere on a machine i cant use, sell, or trade in. Im very upset with John Deere.

If I was walking in your shoes after a few months delay in warranty repairs I WOULD HAVE STOPPED SENDING PAYMENTS.

Contact an attorney and have them write your JD dealer and JD Corporate, a direct and clear letter, notifying them, you consider both the dealer and JD Corporate are in violation of the manufacturer's warranty agreement, and have a deadline of 30 days to make full repairs. The intent is to create an elevated awareness within the dealer to initiate expedited repairs with assistance from corporate Regional centers.

I am not sure, I have not used an attorney for 20 years, but perhaps $225 to write the letter is a fair cost estimate, and varies by attorney.

It appears from viewing 4044M parts catalog that R&R of rear axle seal ""isn't rocket scientist technology"". If it was my tractor I'd jack rear end up then remove axle housing/seal(key 2) & install new seal with the aid of a block of wood.

It sounds as if tractor doesn't REALLY have a warranty worth waiting for dealer to repair!!!

Stop sending payments? Then Deere would repo the tractor, repair it, and sell it to someone that will use it. Why would the dealer get a rare tool if they don't have a tractor to use it on yet. We don't know the whole story....we don't know of the history.

I didn't state to stop making payments long enough for repo proceedings to transpire just long enough to get some attention from credit dept.

Many yrs ago I was employed by a JD dealership for 21 yrs & having served 13 of those yrs as a dealer service manager. JD's service dept issued a list of special tools that were a required purchase by dealer in order to sell certain products. That was a long time ago & JD isn't the same company it was 40 or 50 yrs ago.

John Deere is a joke. I wonder if they have the tools to fix the $350000 plus equipment they sell. I guess if a chopper or tractor goes down during harvest they tell them to wait 5 months.

That was a long time ago & JD isn't the same company it was 40 or 50 yrs ago.

I think you will find that no company is the same as a half a century ago. Back then stock buy-backs were illegal too.

Deere credit is a totallty seperate entity and has nothing to do with this matter.

Even dealerships operate their departments as seperate entities. I once witnessed how my stepdad bought a Dodge from a very pleasant salesman. A few days later my stepdad approached him about an issue. That guy referred him to the service department, but in a manner that he might as well just have told him to get lost!

Like has been said, there are three sides to every story. We have ONE.

I might well picket a dealershop, while remaining on public property, if I became annoyed enough.

If the owner of the 4044M defaulted payments long enough for tractor to be repossessed what dept would you think would pick the tractor up(Finance or service)?? My experience indicates service dept.

I was not advocating default payment enough to warrant repossession just enough to get attention!!

I too have served as Service Manager at 2 dealers and agree that there can be many "stories". Some people just have buyer's remorse, some claim a service problem but never bring the unit in, some think their unit should last forever without any mechanical issues, some WILL default on their loan only to get the short end of the stick. Sometimes, mechanical stuff needs repair and it is up to the owner to set up a schedule for that repair. Then, it is up to the shop to make every effort to satisfy the customer. Were bridges already burned in this story? We may never know.
