I know now that I was lucky to run a lawn business for 6 years and not have any problems other than the occasional bad check (happened twice and got corrected both times). The world would run so much smoother without clowns like that guy.

The state I live in allows you to counter sue in a case of fraud for the origional amount, ALL attorney fees, and time lost. So if you get $100 per hour driving a tractor then all time lost from work (driving to atty office, sitting in his office and going back to work) he is responsible for that at your going rate. GO GET 'EM.

entitlement 'syndrome' some people think the world owes them, and that of course goes hand in hand with them not having any sense of personal responsibility.

I hope folks are receiving what I believe was the original intent of this post. There is a lot to be considered when you take your machine on someone's property to make an extra buck.

FMJ, I agree with you that the best thing you can do if the "jerk" drops it is to drop it as well. I sure am sorry that you have had to deal with this dirtbag as much as you have.

I am kind of curious if the local states attorney is aware of this situation. Even if FWJ doesn't want to pursue the fraud charge the states attorney might. And he should. This might prevent this from happening to someone else.

Good point...and they should.. This guy has probably done something like this before.

I would try to get this guy for "slander".... because once your reputation is gone...then that's it for your business.

But FWJ knows a lot of people...and i would say that a lot of people knows what kind of work he does.

But this guy is probably telling people what happened to his property.

Wow too bad...

Just the fact that you have to set in motion resources for your defence, kind of sucks.

All states should have laws that would allow recoup of resources on any type of suit being brought forth. That, IMHO, would limit these get something for nothing ideas.

I am a firm believer that "every dog, has its day".....

Too bad you cannot go dig up his "compacted" soil, a little aeration would help, don't you think?

Looks like a "peaceful end" is in the cards. My attorney and the opposing attorney decided to cut to the chase and get everyone in one place at one time so we could put an end to what would be a giant waste of EVERYONE'S time. So Saturday afternoon, we got together, myself, my attorney, the complaintant, his attorney, the plumber, and a person who I invited, a health dept inspector who is well versed on septic systems.

I had my say. I let it be known that I wasn't about to cave in. No free money. I told everyone I have enough "background" on the situation to bring fraud charges should the case continue. The plumber let everyone know he was going to tell the TRUTH, and NOT take either side. (Truth plays in my favor) Health Dept inspector said with info on existing system, as it was originally installed, the laterals could not have been harmed under present conditions. He said "issues" with system were NOT symptomatic of soil compaction on laterals anyway. He let it be known that should this become an active case, he would seek to have present system condemned. Both attorney's made their feelings known, that the case would probably be tossed due to lack of proof that harm was done.

Then the complaintant spoke. He said something to the effect that since everyone was "ganging up on him", he'd just have to fix the problem himself and "let us off the hook". His attorney will follow up @ 9AM this morning (monday) to have suit dismissed.

And then another "party" arived. The board of directors for the home owners association. They now INSIST the property owner keeps weeds/grass mowed to less than 10" at any time. I refuse to mow it again. Owner says he WON'T mow it again. HOA say he will.

All I know is it won't be me cutting it next time. I don't need the grief.

It never seese's to amaze me how ignorant some people really can be. This guy clearly has no moral center and his with arrogance he will try to again on the next poor schmuck that he finds to cut those weeds when the HOA pushes him hard enough. Hopefully the next person he asks will see this wonderful little thread and think twice about it.

What you have is a person that can talk themselves into believing anything. I have dealt with this kind of person before. At the beginning, he didn't believe you hurt his septic system, but he talked him self into it. Pretty soon he has convinced himself you did it, and there is no doubt about it. There is a little voice in the back of his head that knows this isn't true, but he doesn't listen to it.

His own lawyer doesn't think he has a case, yet he is still in denial. I'm glad you prevailed.

Wow, just amazing!! I think the guy knows the score and he lost big time. If he's truly having troubles with his SS, then they were obviously there before you ever mowed his place and I believe he seriously thought he could bluff you or scare you into paying to get it repaired. His comment about having to take care of it himself now was his way of saving face without admitting he was trying to rip you off.

As for his HOA, I live in a sub with a HOA and they can levy a fine if needed to "coerce" a resident into doing the right thing. If the resident doesn't pay up, then they can put a lein on their house. Wonder if his HOA has that set up in their covenant? If they do, they can "lean" on him if doesn't keep his place mowed now!! :)

That is good news but the real question is .......did he pay your bill for work done?

I just read an article about this the other day. HOA foreclosing on people because of delinquent HOA fee's :eek: This guy just might 'get his' in the end with his current attitude ;)
