I would send a certified letter to Kubota Credit stating that you never received the equipment you bought and financed. And that you were making no payments until you acquire all you paid for, in working order. Until then, enjoy your free tractor. I expect the dealer has been fraudulent in turning in a sale to Kubota Credit, without delivering the mechandise. I expect Kubota Credit will promply take action, against the dealer, when you refuse to pay. I would also threaten to have your attorney get involved, even if you dont hire one yet.

Thinking this is excellent advice. Too much money involved to just sit back and wait for them to make things right. I can't imagine this dealer will be around long doing business in this manner.

A number of years ago, I had a problem with a laptop from a major vendor. They gave me the run around for several months, even sent it in and they "repaired" it... it would turn off randomly and lose data. I finally got a refund, but they wanted to give me pennies on the dollar. I threw a fit and got a full refund.

I asked a VP that had called, "Why do I have to be an A$$hole to get you to do the right thing?". He authorized full refund a few minutes later.

Google 'demand letter'.

A demand letter got me out of a similar situation. Send it registered mail and wait for good things to happen. In my case, it was an immediate phone call and promises kept - quickly. 100% satisfaction in two days after weeks of being a nice guy. Cost about 5 bucks for a registered letter.

Sit down and make a timeline of the events. What was the agreement (contract) - attach this to your letter. Timeline with contact information - who, when, what was discussed and agreed. Copies of cancelled checks. Basically, send them all the evidence you would show a judge in a court of law. A demand letter format allows you to lay out your evidence and then make your 'demands'. Something to the effect of '... and if you do not do X by Y date, I will remedy the problem in Z such manner - and I will then collect the difference from you in the small claims court process. They will look at that info, realize they are screwed and that they are dealing with someone who is organized, serious and pi$$ed off.

I hate being the big, bad wolf as much as the next guy. Sometimes that is what it takes to get action. It is important to never raise your voice, never talk down to anyone. Polite, professional, but FIRM.

You've done your part (written checks to Kubota credit). They HAVE to do their part. It's part of the purchase agreement. Simple, really. And they know that...

Good news, Kubota just called apparently the order was placed on a stock order which is like a 3 month order, they are suppose to be overnighting the parts. So it looks like contacting them via their website is the way to go. My faith in Kubota is restored. :) Thanks to everyone for the help.

I'm slower to say all is well, I wait until parts are in hand, not just promised. I hope that your dealer gets parts, picks up your tractor and gets that backhoe installed correctly so you can go have some fun learning to use it.

We have had to dig some water lines up in the last couple weeks and could not have done it without our backhoe..

I still fault your dealer. He should have resolved that directly with Kubota himself. Not let it up to you as his customer and cause you so much grief. :thumbdown:

Yeah your right, it was just not ordered correctly apparently. They should have put a lot more effort in figuring out what happened to it.
