Maybe you should send him an empty certified letter envelope just for amusment..

JL, do you know if this tractor is financed and payments still due? If so could he be using this as an excuse to walk away from it? Maybe it doesn't matter to you, since I would guess it would become the finance companie's issue. If not fianced you could have a TBN auction, get your expense out of it, and if $$$ is left over, give it to your favorite charity... Of course it may be that charity does begin at home. :thumbsup:

That can work. When in retail business I thought I was going to have one bad check which would have missed up a perfect record of no bad checks.

I sent a letter like that and it was rejected and returned but he sent in the money for the bad check by a family member. :thumbsup:

Are you now or will you begin charging storage? Not like hes a particularly good customer your trying to keep. Id be charging him. If this goes where i think it is, the fees could be used as a good negotiating chip.

He paid me cash for it, I don't know if he financed it threw his bank or not. Not a bad idea tho, I would have to do some more work on iy before I let a TBN buddy have it tho. :thumbsup:

Cyril- Please don't misunderstand. My post at 367 was just a result of seeing your unrelated post, and was a 'humor' attempt. I read many 'Threads' and I've typed a reply to one, in the wrong catagory, and felt foolish afterwards. What I didn't understand was the continued responses from others re: Backhoe Controls?? I don't think anybody mentioned it, but if this was a daily user, wouldn't there be shiny teeth on that flywheel?? Those teeth look as rusted as everything else. I got it, he must pull start it every time, that way he never has to replace a starter!:laughing:

I don't know about the laws in Texas or how they apply on a tractor, but up here, if it got to the point of a machanics lean and a vehicle was sold, any money beyond what is due to the repair shop belongs to the title holder. Again, not sure how that would apply to a tractor since it has no title.

If its in his possession and I have a lein on it by law he can't trade or sell it without me being involved now if it is in my possession (which it is) and I put a lein on it he can not touch it and I can have a judge rule I can sell it. To regain my money plus the court cost. Any money above that is given back to the customer, but I can add cleaning cost and a commission bonus to my salesperson. I do have to try to get a real value price for it tho

Gotcha- It was my feeble attempt at a little levity, but I would guess you are correct. With that said, there is a tractor -pull this weekend in my neck of the woods. maybe it could entered and see how the clutch is working now!!

If it comes to the point I have to sell it I have to send him a certified letter and he has to contact any loan office that has it for collateral and they have to contact me. If he does not and defaults on the loan they can charge him with theft. I realy hope it doesn't come to that.
