EPA Certification

If I understand correctly you can still get non-certified engines into the country under the manufacturer "transition flexibility" exemption of 40 CFR 89.102. Which gives them 7 years from Jan., 1999 so for a tractor of less than 37 KW (50 hp) thats through this year. For less than 25 hp through 2007.

Any dealers still getting tractors without certification through these exemptions?

In EPA interim ,Dealers can get tractors without certification through these exemptions.But After 2004 .You cann't

2005 was the 7th year for this class. (1999, 2000, 2001, 2002, 2003, 2004, 2005). Technically, those who established a TPEM program as a "manufacturer" could still bring in under 25HP tractor this year. You were only allowed ONE engine manufacturer or family in each HP class, so if you imported Lenar or Benye you couldn't switch to Jinma or KAMA unless it had the same engine you had slecected for that HP class. There are some exemptions, but only for the OEM, not at the importer level. The more popular engines are now EPA certifed. I hope they can maintain the certifiecations as the bar gets raised. Tier II to Tier III, etc.

As for companies like Foton, any new designs, such as the 120+ HP models are being release as EPA approved. They are specifically designing models for North American and European use and keeping these EPA specs in mind.

In addition. Any construction equipment they are offering a choice of outside engines such as cummins, perkins, deutz, etc... I'm hoping they will some day do this with the tractors. The perkins engines in the Yuchai excavator is a beutifully quiet and extremely efficient engine.
