Will Stellantis just pass the buck to the truck owner saying they should not have been driving it? :unsure:
Of course they will try. But they'd be arguing uphill on that one, as it's not a reasonable response to tell people they cannot drive a vehicle, given that a vehicle usually represents such a huge fraction of one's income and net worth. I think they would have trouble winning this argument.

@Code54 isn't there a class action lawsuit over this that was settled? (Not that $3k makes up for your pain and suffering...)
I'd be reading the terms of that settlement very carefully, before signing on. It usually comes with a forfeiture of your rights to seek any other compensation or damages, releasing the other party from all obligation.

The recall said they expected a fix by end of first quarter of 2025. A year later still no fix. How many engeneers are working on it?
It's so unreasonable to expect someone to park their truck for a year or more.
The loaner car should be an equal truck and expect it to be used as an owner uses his truck
I'll bet if they had to do that; a replace part would have been available sooner.

Being that the vehicle was built and certified with the anti-lock braking system, Stellantis will own the liability if people get hurt in an accident. I would assume that is forcing the do-not-drive warning. If people died in an accident and a good lawyer gets their teeth into the cause, it could cost them huge. Will Stellantis just pass the buck to the truck owner saying they should not have been driving it? :unsure:
And thats the thing.. If there is a 'Do Not Drive' order with no repair and you are unable to safely use the truck for a long time, would that not fall under the Lemon Laws then? Would Stellantis not have to buy it back? Many legal ways this could go, IMO.

Lemmon Law generally applies during the warranty to items that substantially affect use, value or safety and buyback is an option after reasonable repair attempts fail…

Reasonable could be once or could be three times as reasonable depends… did the brakes fail once and then again after repair?

Consumer protection statutes generally provide for automatic warranty extension for the time the warranted repair caused the vehicle to be out of service… something not always realized.

It costs nothing to request arbitration in California…

Different manufacturers have specifics steps to request.

Buybacks will deduct for the use received…

True, but in a case like this where you have a vehicle that is under recall and is 'undrivable' due to that recall (in the legal sense, anyways) and the OEM is unable or unwilling to provide the repair, or even the part, to fix said recall and thus remove the 'Do Not Drive' order..? Ya, I think even just a decent lawyer would be able solve this to the buyer's satisfaction.

A lawyer is rare in a Lemon Law proceeding as the concept is Alternative Dispute Resolution.

Often just going through the motions will move you to the top of the list with no lawyer and no Lemon Law hearing.

I’ve never had a Dodge Lemon Law case… most of mine are GM…

During the pandemic one of my cars became subject to the airbag recall and it took over a year… but I was not really using the car…

The recall was misleading because it said not to drive and at home service as an option… well, no dealer offered at home repair and they would not pick up my car…

The service manager said via email I would need to bring the car in and almost every airbag recall had the car driven in… go figure?

Probably not an ā€œengineeringā€ issue as much of a supply chain issue.
The defective part cannot be replaced in large quantities fast enough.
