I hope my reply not a hijack but it applies to this thread. If so, I'll delete.


Well, if you speak with the bank and explain the situation and if it involves fraud on the other person's part, they will stop it for you.

Back in 1989 I bought a Kubota M6950 tractor from a small dealer in rural Maine. It had 1200 hours on it and the dealer said he sold it new and took it in trade from a local light-use guy. It looked great; new tires, loader. Now, I am extremely thorough in my purchases, can engage in conversation and not leave loose ends. I paid attention.
Except this time. Normally I would have contacted the prior owner and crawled underneath but I was in a suit. Plus, I was a locally well-known guy and usually got treated right since I had a public forum and could impact others. I was well liked but a regular guy and nobody screwed with me.

Since the dealer was local, I accepted what he told me as fact and took his word. I wrote a $17,500 check and had him deliver it. When I got home and looked closer, something was odd. The hour meter numbers didn't line up and there were leaks and use not typical of a light duty tractor. Oil blow-by. Huh?
I called a Kubota factory guy I knew and he checked the history of the tractor. Not only had it not come from this dealer but it was used for municipal mowing and snow removal in a Canadian town (think 25 below and plowing snow) and recently had tear-down warranty work done at nearly 4000 hours by the dealer I bought it from. It was all a lie.

I quickly called the bank, explained and substantiated the fraud and they put a hold on while I drove to sign the stop payment. While I was there the dealer was at a different branch trying to cash the check. Later, that dealer apologized and wanted me to lift the stop and then he would pay me back to "save his reputation". Start whistling Dixie cause it ain't gonna happen.
Guy not in biz any more and I wasn't the first. Crooked is as crooked does.

But what your describing is not a mechanic's lien.

He might have been decline on an insurance claim also , because the claim adjuster would have asked the client how did this happen , and if he says he went in the water with his tractor , it would most likely be excluded.
the only way it could be covered if it would be a flood or accidently fall in water.

Does the tach cable also drive the hour meter? Could have been disconected a long time ago. Would not put it past this guy to do something like that.

In the first picture of the tach cable, what's all the junk sitting on the bottom. Looks like mud, sticks and leaves. Is the tractor stored outside all the time? You may have said way back many pages ago. How is it that dirty for so few hours.

I cant answer this question because he paid cash for the tractor. I dont know if he had the money or got a loan threw the bank.

Yes sir it is dirt, leaves and sticks. It does sit out all year long under a oak tree. And to the OP the tach does operate the hr meter so there is no telling y it was loose.

There is your biggest answer right there- Tach runs the hour meter. So his daily use tractor with few hours more than likely has a significant amount more than on the clock.

Seems the fellow would have been banging on your door if the tach wasn't working right from any point after he took delivery (yes, assumed on my part). I would be highly suspicious of what the true hours were. Just because there are tamper proof's to prevent turning meters back, doesn't mean you cannot temporarily disable them to keep "good" hours on it.

Kinda what i was thinking but didnt want to open up another can of worms with this customer. Just glad im almost done with him and no it seems like he will be JD's problem. Sorry Deere:laughing:

:( What the hey?! Most warranty is calender not hrs. And it was loose not disconnected. Why do you assume the tach wasnt working? ... and if it wasnt, and does have more than shows on the clock that tends to substantiate the OPs claim of regular use which people have been assuming as a lie.

Because the obvious answer is it gives the owner of the tractor no ground to stand on and that coupled with his attitude speaks volumes.

Has anyone considered the fact that the owner may be a member on this forum, and is getting info to back up his claim. Also there is the fact that the dealer has stated what he will do and not do.

On a side note, do you realize that a brake drum will rust over a wet weekend just from condensation.

JJ--the clutch was so rusted together it had to be chisled apart and that didn't happen over the weekend. Well, maybe at Roswell or Area 51.
I think it's at post 58 or around there.

I totally agree about the rusted clutch. It is suspicious. Just one dunking in water would not do that unless the water was retained, or there was continuous moisture.

J_J, I think I was more than fair with the customer. If he does read this then that is ok. Most posters believe it was neglect on his part while a few others came up with some good points on how it could happen also. The tractor was out of warranty and it was MF's call on how to fix it at this point. I believe they did a fair deal in paying for the parts, they could have said NOPE, OUT OF WARRANTY SORRY, But they didnt they stepped up and is trying to help out. I know i did my part and i think the customer knows it to.:)

I think MF went above and beyond on this one by offering to pay for the parts even though it is out of warranty. That is something MF does I am told, which makes me feel even better abut my purchase. I think this dude was playing in salt water somewhere with this tractor. Could also be the Japanese who put it together screwed up like they did on mine.
