Purchased new tractor that is rented out?

/ Purchased new tractor that is rented out? #21
Maybe I'm wrong but when you pay for an item at that moment
it belongs to you. Example when you pay for a new car/truck
that's on the lot you don't have to wait for a few weeks to get it
its yours as soon as you pay for it you may have to wait until the
next day to pick it up as they have to service it or check it out first.
It should be the same as with a tractor or anything else.

The purchase order should stipulate why the new owner, that has paid for the product, can't take possession immediately. How can they sell an item that someone else has dibs on (the people using it)? What if the OP would call the police and would say he didn't give permission to those people to use his new tractor?

What a mess.....

If one were spiteful, I suppose it could be reported stolen? 🤣

If the purchase/sale document does not stipulate when you take possession, I would think the default is as soon as the paperwork is processed. Certainly, by the time the funds change hands.

Can go back and forth, but the real way to solve this is to call your dealer and ask them what is going on, tell them you expect the tractor by the end of the week and that it be clean, newly serviced and in good working order.

If they can't do that, then its time to negotiate further discounts/ free service or get a refund. Coming in hot and angry ain't gonna help, I've tried that approach in the past and it just pisses people off and slows things down. Be reasonable, but firm in your request and stick to your guns if they try to sweet talk you.

Good Luck!

I wouldn't buy it. What if, now that you own it, something happens to it? Who's responsible? The renter, you, dealer, warranty? You may own a damaged tractor with no one responsible but you. For myself, there wouldn't be enough money off to purchase it.

I would start at the dealer. Be polite, but very firm. You expect your tractor to be delivered immediately. No nonsense. If they push back on that, tell them your next stop will be the DA's office, or possibly the police/sheriff's office.

The rental company is making money off of equipment that does not belong to them.

Put a stop on the check immediately, that will get their attention real quick.
If that doesn't work, visit the D A office today, I have never heard of such a thing as this!

Where is this dealer located?

A couple old sayings come to mind: "No one washes a rental car." "He beat me like a rented mule." I think the implications are clear . . .

You said that when you purchased the tractor it was "out on rental". That's not a new tractor -- That's a used rental unit. Not even a DEMO unit -- it's a rental unit.

It's hard to understand how you and salesperson could strike a deal and finalize a sale without discussing when it would be delivered to you. Did you mention that you'd need to do a final inspection or have it checked out when it came back from this current rental duty?

Seems like there must be more to this story. I can't believe that any reputable new equipment dealer would take the position that they could rent YOUR equipment and leave you hanging like this. I'd like to hear the dealer's side of this story. What exactly are they saying to explain this situation?

There's got to be something is missing from this story......
I cant believe such dealer behavior exists out there.

Yeah... Sounds like trolling to me. ;)

Why would anyone pay for a tractor when they can't take immediate delivery of what is purchased?

Tractor dealer can send a new tractor to fulfill the rental.

Why wouldn't you ask when delivery is expected?

LOTS wrong with this thread...

I am thinking there's more to the story. Very weird. The deal does not make sense for the buyer.

Municipal workers are very hard on equipment

I might differ on this point. "Government" workers aren't usually pushed for productivity. They and their supervisors don't depend on keeping a tractor or truck or backhoe "busy" in order to make a profit and keep their jobs. They usually hire out their major work to private contractors who are working on a margin. Often the city equipment sits idle. When it does go out, it's used by a small crew to do some relatively minor work. Depending on the city, they probably have their own civil-servant garage mechanics maintaining everything.

Next in this hierarchy would be utility companies. On average, they are not as hard on equipment as their contractors would be. On the other hand, they sometimes keep equipment until it's rusted out. Both utility company and city/county/state equipment is usually replaced due to AGE instead of HOURS.

In general, I'd rather have a tractor that's been used to sweep sidewalks or mow right-of-way, etc. by a city crew than the same tractor used hard 8 - 10 hours per day by a contractor trying to make a profit. Look at two backhoes bought at the same time -- One is hauled around on a trailer by the city and used to replace a culvert every now and then. The other is owned by a contractor working for the same city doing sewer work 50 hours per week.

Generally speaking . . .

What’s missing?

Who would pay for a tractor that is actively and currently being rented out, and the buyer has no indication of when they will get the tractor? I mean, that seems completely implausible.

I paid $36k in the form of a check for my tractor and implements on the day they were delivered, after they were unloaded and in my barn. The dealer was perfectly fine with the arrangement, he didn’t even need a deposit when I ordered it.

I can’t believe a buyer would agree to what you claim to have agreed to. And I cannot imagine a dealer with the balls to actually leave a buyer hanging like this.

Sort of like Ivory soap... 99 and 44/100ths pure but in the case 99 and 44/100ths BS. You have to admit, the OP was pretty creative...
