Purchased new tractor that is rented out?

So I purchased a new Case 75c about 2.5 weeks ago. It was out on rental, but they won’t give me a time of when the rental is supposed to be done. I’ve bought and paid for the tractor. There is nothing stating it’s allowed to be out for rental still. Is this a normal practice? Should the tractor be delivered now or should they be allowed to continue using it as a rental to the city?

I guess you bought a demo not a new tractor..I would want my money back or a new tractor with under 3 or 4 hours....

Yes, it’s a demo. It was significantly discontinued because of this. I’m just curious if I should tell them to deliver the tractor now or let them continue renting it out to fullfil the rental contract.

What does your Contract say about this? You said "There is nothing stating it’s allowed to be out for rental still". But what does your Contract say about Delivery Time?

It depends on what the deal was.. How many hours when you looked at it? Did they tell you when it would be off rental with x number of hours or days/ weeks...

When did the purchase contract say you would take delivery? If it was immediate delivery, I would want my share of the rental fees. If it had a delayed delivery date, I dont know you can say much, if that date hasn't passed. I would be concerned if this drags out.

Once you pay for it the tractor is yours the dealer should get them another tractor...

What was agreed upon delivery date when you purchased the tractor? If end of rental contract? My guess rental contract unless they have a replacement for rental.

There’s no agreed upon date. It doesn’t state end of rental

Seeing as they're using your tractor, shouldn't you be compensated for it?

I've never heard of such a situation; you paid for the machine, the contact is signed, someone owes you a tractor or owes you some cash.

Call the dealer and ask them who is getting the rental money. They sold it to you and now they are making money off of your tractor????? I agree with 5030, it is less than a normal "demo" tractor.

Yeah, that’s what I was thinking. I’m calling the dealer and a consumer attorney tomorrow. It’s been rented out for two weeks already and the dealer said maybe another 2-3 weeks…..

I bought a 3 yr old tractor from a rental fleet. It had 1100 hrs on it and looked like it was beat with an ugly stick. I paid 50% of new. The dealer changed all fluids and filters and put 4 new tires on it. I ran it without issue for 14 yrs and sold it when I downsized to the Kubota 5200MX. It can work out.
