After the storm passes, we will make a sad trip to CA. A little over a month ago, our beloved Golden Retriever passed. He was only 8 1/2 years old. My wife and I still grieve his loss.

Looks like the wet weather has slipped to Saturday, but we'll still get several days of mild rain out of the next storm.

Has he received a "Cure Notice" sent registered mail from you? That would be your first step in the legal direction. Then if he continues to ignore it, contact the zoning/building department and file a formal complaint. If that is ignored, file a lawsuit in small claims, or if over the small claims limit, hire an attorney and file in superior court. Just make sure you track your time and expense in making any repair to substantiate your damage claim. I don't believe you can sue for emotional distress in small claims, but you can in a higher court if damages are substantial. Unfortunately, the higher the legal escalation, the more it will cost you before any satisfaction is obtained. And even if you get a judgement against him, you might well have to spend even more money to collect it.

There are some pretty sad tales floating around here on TBN about neighbor issues. I hope you can resolve the problem quickly and inexpensively, maybe with just a letter from an attorney.

Thought I had unloaded all the boxes, but I forgot about the ones that came down in the Camry. One had a bunch of bananas, and it's been sitting in the car since last Thursday. Now they're very ripe, but very sweet, too, just the way I like them. I knew I'd packed all my tableware to bring down, fully expecting a box from the trailer or van to contain it. I unpacked the Camry boxes this morning, and there it was. Now I'm washing the tableware I was using, a mish mash of old cutlery and my camping pots'n'pans. Serviceable, but not as nice in your hands. More incentive to get the move done and someone else in that house up north.

Installed four TapCon screws in the toilet flange yesterday, but didn't torque them very tight, having no experience with either the screws or the plastic toilet flange. Better safe than sorry. Should the rest of the install done this afternoon.

Amazon delivered my propane tank finally, so I drove up to TSC and got it filled.

up some zinnias that were too close to the side.

for fun I also planted a few bush beans in pots.
want to take pics each day for nephew's little kids.
I also planted some cucumber seeds and will repot them several times, see if they will grow in greenhouse until April.
they will get staked when they go out. Safest day here is allegedly April 15.

I only know part of the circumstances.

But one thing that is universal is to have good documentation of events. That helps in every case if it has to escalate.

I think I would begin sending letters to your neighbor as you encounter added work or damage. Remember that such letters are more probably for a judge or regulator to read, down the road, not so much the unruly neighbor. So keep the letters polite, professional, non-accusatory, and stick only to the facts. A judge or regulatory agency will appreciate that down the road.

I would point out that the pond used to exist without prior problems. Then changes were made and problems began. And on X number of occasions, you have had to expend X labor hours and X amount of equipment time. Identify a reasonable number for labor and equipment and put down a total cost you are out. Include some photos if there is a reasonable way to get them.

Conclude by asking that the pond be restored to a manner where it no longer causes a problem.

I would keep sending letters each time you have to touch this. And I don't bother with certified mail-- the neighbor can just refuse delivery. And as you send each letter the cost for your time and equipment goes up.

This doesn't mean you can't try other things. But I would get the documentation trail revved up if it is not already.

I think that is part of the problem. Almost nothing is like it was for hundreds of years. I think we are over run with examples of things changed uphill with little to no regard for the results. I think this idea Frits situation to some extent.
When we lived in Atlanta we had a similar problem. Almost any rain and our street would overcome with waterflow, even some yards flooded. Neighbors were quick to say that when the area was new that was never a problem, but it became one when the MARTA station was built about 1/4 mile and uphill away. Being a different government entity, no problem. The only solution years later was to add a curb type (think speed bump) at driveway entrances on the downslope side of the street in hopes of diverting most of the flow. We were fortunate, but I’ve seen where our next door neighbor couldn’t get to or from their car, let alone store anything in their crawl space.

Living on the side of a mountain in an area that expects 120” plus a year, this is something we pay attention to and sometimes shake our heads when the latest mainland arrival quickly recontours their property, often expensively.

Sadly, unless things have changed, no cruise ships to Hawaii as a final destination, just a short stop. Something related to shipping laws, like Jones Act. We had some old neighbors recently cruise from west coast to Tahiti with stops in Hawaii. I think there are also cruises from west coast with multiple island stops that return to west coast. About 14 days trip.

A nice quiet morning just piddling about the house. Made a nice surf and turf for my favorite Valentine. After a glass of wine, no longer motivated to play mechanic as opposed to just being in the presence of my best friend and love.

Good (Thursday) early arvo. Overnight Low of 7.8C and it's presently 24.9C, clear and calm.

Lovely, intimate, Ash Wednesday Service yesterday. The wee jobs at the Church Hall went well... I installed a couple of 'latches' on some doors to render them safe for when Sunday School is underweigh.

This morning involved a 'Foot Dude' appointment to have my toenails cut & calluses trimmed. (it's a Type II diabetes thing = no ingrown nails). Seeing as I was close to town, I headed in to have some scripts filled and paid my annual bill for having a PO Box. At least I get charged half price for it because the PO don't deliver to my address.

Other than that, I've got a dinner/meeting this evening @ 1730.

Here near Tulsa, the thermometer says 55 and clear, good breeze out of the south. Heading to Yellville, Arkansas later this morning, hoping to dig some fence post holes on the creekside property, then returning on Friday with the trailer in tow so I can haul the fencing back the next time we make the trip.

Drinking cup of coffee. 25° with cloudy skies this morning. Heading to 39° with clouds, snow and wind. Grocery shopping was good. Except forgot my list. Managed to to get all things that were on it but one. Its already on next weeks list. Started working on a dolly for weight box. Will continue with that today.
Woodpeckers a going through suet cake quickly this year. Hope Menards has a sale on them soon.

brrrrrr, 18 out now, only getting up to high 30's today
looked out and greenhouse was faintly glowing red, so heat stayed on it there.
I put a full propane tank in there late yesterday, and this one has a built in gauge, with an internal float.

I told my friend to forget about getting a 100 pounder for me. It's just too much for me to do
myself, so I'm sticking with 4 30 pounders.

not sure what I'll get in to today.

Ron, I bought several of those big seed cakes, was so impressed with yours, and of course they
did not fit in regular holders. So I tried to cut them in half. Tough stuff. Finally got a big cold chisel and a
hand sledge and wailed on it, that did it. Stuffed halves and pieces into some existing bird feeders and once the
big birds like cardinals and blue jays found it, started pecking away. With all this snow on the ground, birds have less natural
food out there, sure seem to like my to go meals. There is one spot under my picnic table that did not get snow so I put seed under there and little
birds love it.

that does remind me, need more bird feed. Local tru value has a pretty good selection. We also have a "gourmet" bird place nearby
but their prices are pretty high. Hard to beat sunflower seeds, but those seed and suet cakes seem pretty popular in colder weather.

Spent all day on taxes. This has been the hardest year but got them e-filed last night...just need to drop the K-1s into the mail. I guess I'm not the first one to say how messed up the tax regulations are...if you agree, substitute your choice of terms for "messed up." Even using Turbo Tax for this was clumsy and unhelpful. Now I need to start on my own taxes...should be simpler.

My valentine finally came home at bedtime from staying with her mom. Both of us worn out.

I'm gonna do something fun today. Don't know what, yet. Any ideas?
