Fergie's in ICU

I suspect they'll need some prodding and pestering before this is completed.
I think I'd be calling and/or visiting in person if not to far, for an update like every
3 days.

Then 2 days

Then every single day if needed

The dealership is 30-miles/45-minutes away. Yes, sometimes "the squeaky wheel gets the grease", but it can also piss them off if overdone; tough to know exactly where that line is.

Good point. But I'd also be pissed if I had a hole in my block. Might need to at least get toe on the line 😁

Time to ask them for a loaner!

Not sure if you're making payments on it or not ... I'd ask them to suspend them if you are - Interest free!

Can you call a regional customer service agent? Sometimes they have ways of getting the fire lit under the local dealership!

Massey will probably drag their feet on this too. Nobody is going to want to pay for it. My only suggestion would be to keep very careful notes of every interaction with them, promise date, next step, etc. If things need to get escallated, having things well documented will be a big advantage. Also, when talking to them, ask what the next steps are, and based on that, agree on when you should check in again. If they have opened a warranty claim, as for the claim/ticket number. And I agree about asking for a loaner and suspended payments. Anything that gives them some incentive to get the tractor fixed. Otherwise there is nothing to keep them from taking all the time in the world.

You might also consider asking about a replacement tractor (permanent, not a loaner). For some $$, they may be willing to put you in a new tractor. Only you can decide if it's worth it, but couldn't hurt to explore the option. I suspect this will take minimum a month to get you repaired and running again, and could easily turn into multiple months. So time without the tractor is a consideration.

The lack of response thus far is really disheartening.

I'd reach out to the local AGCO rep if you're able to. Light a fire. If you burn bridges with that dealer, at this point, my thought is there will always be another.

The problem with asking for a whole new tractor is he has quite a bit of hydraulic and aftermarket stuff on this one, while nothing to do with the engine, it would take quite a bit of time to transfer all of that over ...

I don't think it should take too long to simply look at it, and see if a rod came loose, or if it broke, (1 Hr?) either are immediate replacement criteria!

Then figure out how long to get a replacement shipped, and installed ...

Your warranty clock stops when warranted item is out of service for a covered repair…

Some have extended for many months.

The Magnuson-Moss Warranty Act can indirectly extend your warranty by allowing for a cause of action for a breach of warranty or service contract, even after the written warranty has expired, provided the defect appeared during the original warranty period. The Act also addresses situations where you're deprived of your product for an unreasonable time due to warranty repairs, allowing for an extension of the warranty period in such cases. Additionally, it provides legal recourse, such as for attorney fees, to ensure consumers can enforce their rights under the federal law and state lemon laws.

How the Magnuson-Moss Act Extended Warranty Protection
  • Claims After Warranty Expiration:
The Act creates a cause of action for breach of a written warranty, which can be pursued even if the warranty period has passed, as long as the defect occurred and was present during the warranty term.

  • Extension for Repair Delays:
The Act allows for the extension of the warranty period if the consumer is deprived of their product for an unreasonable amount of time due to the need for warranty repairs.

  • Broader Consumer Rights:
It provides broader protections than many state lemon laws, applying even if a vehicle is slightly outside state-specific time or mileage limits but still under a written warranty or service contract.

  • Protection for Used Cars:
The Act ensures that a used car with a written warranty or service contract is protected under federal law, preventing the sale of such a car "as is" during the warranty period.

  • Attorney Fee Recovery:
A key feature is its fee-shifting provision, allowing consumers to recover attorney fees incurred when they win a case, making it more feasible to pursue claims for breaches of warranties or service contracts.
Steps to Take
  1. Document everything:Keep records of purchase dates, all communications, and repair attempts.

  2. Allow reasonable repair attempts: Give the warrantor a fair opportunity to fix the defect.

  3. Escalate the issue: If the problem persists, notify the manufacturer's customer care contact.

BTW, I found out that a complete new engine will be $8700 if they don't honor the warranty; I might get a small discount on that, but then there is labor too.

Yes, but that's just a short block. If the head is also damaged, then a replacement for that is another $2200 or so, and who knows how much extra stuff is also needed. The complete engine is just that right down to the starter, alternator, water pump, injector pump, etc.

$8700, plus labor, that would surely be around $10k plus or minus a few hundred. That's more than half the machines value.

Disheartening.

I don't see how they could deny the claim ... Unfortunately it will take them time ... Being patient and courteous, all while being persistent will go a long ways ...

What I mean is "bother" them every week or so for an "update".

   / Fergie's in ICU #79
Remind us again how old the tractor is, and how many hours? As I recall, it's still clearly under warranty, right? To deny coverage, they would have to show a specific thing that you did that caused the failure.

It's never been clear to me whether Magnuson-Moss applies to things other than automobiles. So tractors, boats, UTVs, etc? Anyone know?
