Sorry to hear about your dad. That cemetery is beautiful.

Our house will be built this summer on the place we have there. Excited and stressed at the same time. It's located between Deadwood and Spearfish.
Thanks. My Godfather was buried there a few years ago it's beautiful. Mom may move out there some time in the next year after to be close to his grave. She'll join him there when it's her time.

My BIL is originally from Lead. I've been around up your way a lot. It is gorgeous. The ranch near Sturgis is nice, but more grassy hills than where you are. I hoped to have a summer place up there, but Mrs. T didn't want any part of maintaining 2 places.

I grew up on the opposite corner of the state. Just good farmland and lots of lakes.

yes but no... Its complex and not entirely sure on the limitation of the law and how each would work, but I know that I do not own the fish (wildlife within the lake), it is my proprety and my proprety line but I am not sure if I could restrict access on water (or ice), since there is laws such as Navigable water rights, I definitely own the land below the water but I am not sure if I own the water per say. (my guess is no as water is public)

Regardless I am not worried I never seen anyone on this lake, it is too shallow for a motor boat and not a good fishing lake ether.

I guess it ownership with limitation...
So, was speaking to some guys at work, and #1; It varies in the US by the state, and broad statements will be wrong.

In Louisiana specifically (doesn't rule out other areas) you Can own surface water

In Florida, you can own the buttom of water body, However, anyone can access/use/cross, as long as they don't step foot on your dry land.

You can (in Florida) also own land butting up to TIFF land, state land on at the bottom of a dry lake, in which case, anyone can use it, but can Not trespass to get there.

In Texas, people can also not only boat/wade in the water on 'your property' but also walk/anchor, ect on the ripian area (that would include the banks/flood area) of the water body, even with dry feet, on your property. (If I'm understanding this completely)

yeah so for use from my research it sound like I own the land below the water and the water but cannot restrict access.... that begs the question if something happen who is responsible the ''state'' or the owner... if the owner cannot restrict access then it should be the state but its your proprety ...

''Property Rights: If half of a lake is situated within the boundaries of your property, you generally have ownership rights over that portion of the lakebed and the water above it. As the owner of the property, you have the authority to control access to the lake from your land.''

I own a bit of salt water tidal but not allowed to restrict boaters when tide is in and if they remain on water…

When tide is out they all need to be gone…

Ha, ha. Our first garden was 80x120. This was before all the critters found it. We planted 14 hills of zucchini. Wife and I made - zucchini EVERYTHING. Took several loads to work and give them to the work crew.

It was a great garden. Everything grew so well. I even planted a row of Kohlrabi. Looked like little green Martians. I enjoyed the garden. I DID NOT like doing the work and having the critters eat it all.

I think the final straw - the wife came ROARING in the house. "Do you know what those @#$% chipmunks have done?". They had eaten every one of her strawberries. Just before they became ripe.
Funny story, about 30 years ago, I planted a bunch of strawberries, the kind from the back of a magazine where they grow to the size of a childs hand, fenced in. Something was eating them. Local AG center had a master gardener answering questions on a Saturday morning radio show. Just as he was explaining the possibilities, I saw a chipmunk, sitting on hind legs, holding and eating a strawberry. I rapped on the window and he shot through the fence like nobodies business. I don't like chipmunks...

We have 97 acres of family property. My dad tried to give it to my wife and I but I refused.

We maintain it and are really the only ones to use (wife is out there daily)

Heck the whole family (who's alive atleast) asks me for permission to do some improvements if they find the time to get out there.

Only reason I turned it down is for tax reasons. We had it logged for deer habitat 5 years ago. Due to the laws in this state, you get 20 years of tax breaks. Saves about 6grand a year.

Non transferable. Right now the land is in a trust, put it in my name and tax break goes away
