So I don't understand this process. Is the guy that puts up the red poster just a gopher that has a list of places to tack up posters? Is the law such that you are guilty until proven innocent? What happens if you take the poster down and just ignore it? I'd be tempted to get a lawyer involved.
the person tacking up the red "VIOLATION" poster is the animal control / code enforcement officer. IN our county they are basically the same as police. they have a badge and a gun, can arrest you / issue citations, and court appearance notices.
and yes.. they tack up the poster which specifically reads:
" YOU ARE IN VIOLATION.. etc.. "
When in fact.. you may not be. So far.. none of the times that they come back out and see the animals.. I have NOT actually been found to be in violation.. even though the initial sign they tack up says you are.. and of course lets all yer neighbors know that you must be some sort of criminal...
The poster goes on to state that if you do not call in within x hours or days that they will cite you, issue a court notice, and or get a warrant and seize the animals / arrest you.. any or all.. or none ( may ).. so.. it's not the sort of thing you wad up, throw away and ignore.
given that they seemingly let anyone complain anonymously.. I'm not sure what a lawyer is gonna do for me.. apparrently there aren't even any records to subpeana (spelling? )
i'm stuck.. someone has it in for me and is using law enforcement to harrass me.. and I have -0- recourse.. and the way the law is written ( ordinance? ) if a complaint is called in they must investigate. I asked the officer.. so .. if someone calls on me every day.. you have to come out every day? 'YES' was the answer.
