Just go up to his door and when he comes out,tell him your tired of smelling his ####,and you demand satisfaction,and slap him with your glove,,[make sure you bring a second to wittness this],,,than,,well thats as far as I thought now,,,but the duel should be with deadly weapons,,deer rifles would be best,,but I think thats his choice,,you better hope he don't decide pocket knives,,but chances gotta be taken here,,,thingy

After looking at your pictures, I am sure that is what the problem is, the second vent coming up does not meet code as it is not venting high enough. This is what is providing the smell. There is no trap on a toilet other than the water in the bowl. The trap is designed to keep the sewer gas out of the house, not the smell from escaping to the outside world.

I agree with Dumbdog that does not look up to code (too small and looks low). Building inspector may be able to help you. Any plumbing requires a permit and inspection around here. In the first pic you can see what looks like the original vent further up the roof. If that small pipe on the outside of the building is also a vent then it must be a repair for another problem. I'm not a plumber but I when I built my house I did my own plumbing to code.

I thought EVERYTHING with a drain required a vent pipe for proper functioning.

If he only has one big vent pipe he might have problems and thus his "fix". Since its low to the ground it can smell. Like I said before, I could smell gas when on my old roof in the city. A few times I got a whif if the wind was just right and I was in the yard. His needs to be higher.

Depends on the building code. When I built my cabin, which had to meet all local codes, a independant vent was not required for every drain nor did it have to go through the roof. I tied my 2 sinks, toilet and tub into one large vent pipe that ends in the attic with a vent valve on it.

To test the system I filled the tub and both sinks, then opened the drains and flushed the toilet at the same time. Everything drained rapidly.

Some people are a little nervous about having the vent pipe end in the attic, but as the inspector said, if it has backed up that far you already have bigger problems than poo in your attic. But, the valve prevents anything from coming out anyway.
