Still would like to know the trial you speak of...

Pick just about any murder trial in Harris County in the 60's through 80's tried by Percy Foreman, Racehorse Haynes, and others especially one Sam Hoover. But Hoover's legal work came to a halt in the late 1960's when he went to prison himself for masterminding the Mair Schepps home invasion. That is a fascinating crime story. I can't believe it wasn't made into a movie.

I saw it used very effectively in some cases where the state would not indict the defendant for murder or any felony due to the bad character of the victim. The term misdemeanor murders was well know by police, prosecutors and defense attorneys. It even became known as the Texas Defense although it has no basis in law.

Here is an excerpt: "In criminal law, the claim that the deceased victim “needed killing” is known as “the Texas defense”, also designated as “misdemeanor homicide”. On Wednesday, 27 August 2014, a jury acquitted David Barajas of murder at the Brazoria County Courthouse in Angleton, Texas. Barajas had been accused of fatally shooting one Jose Banda in December 2012 near Alvin, minutes after a car driven by Banda hit a truck that Barajas and his two sons were pushing after it ran out of gas, killing twelve-year-old David Jr. and eleven-year-old Caleb. Although Banda was found slumped in his seat at the crash site, with a blood alcohol level twice the legal limit and a bullet wound to the head, no witnesses saw a shooting, and no weapon was ever recovered. As the case was about to go to trial, Texas media picked up an analysis by kibitzing Houston defense attorney Joel Androphy: “It’s not the right way to do it, but jurors a lot of times make judgments based on moral responsibility, not legal responsibility.” Amplifying this point, the commentariat cited a case two years earlier, when the grand jury in Lavaca County, Texas, declined to indict the man who admittedly pummeled to death the alleged molester of his 5-year-old daughter.

With the passage of the Texas Castle Doctrine we are spending more time prosecuting actual criminals these days and not so much prosecuting people defending themselves, loved ones and their home from the criminals.

It gives me a better understanding of what happened of at least why something like that happened. Here I was just thinking it could be about a guy who got whacked because he kept place looking like a pig sty and would always be drinking on the porch and always having strange women over.

San Francisco CBS 5 doing a story about crime in Twin Peaks had a luxury car roll up with men and a Glock steal the camera gear in broad daylight with plenty of witnesses...

SF supervisor said it’s not unexpected...

God forbid people don't steal property from others because it's actually morally wrong

But I guess at the end of the day, no different than wall street with the thieves dressed wearing ties.

I was reading up on CBS 5 from San Fran to see if I could find the story you were refering to. I stopped when I hit the 100% federal funded program for hotels for you know who (trying to keep politics out of it).

Way too many for a "civilized" nation. Nothing worse than a thief.

I kinda like 'old-school' citizen justice. One guy lamented that while working for gov't in Afghanistan he was invited to watch a public execution and the removal of a thief's hand. IIRC it wasn't his choice to attend the event(s).

OK, it's a bit extreme, but the sentiment is there.
