There is a difference between walking near the line because you don't know exactly where it is or even because the walking is easier on the abutter's ATV trail; vs driving up somebody's driveway unamnouced and parking next to their house to walk 3000 feet to the line you are surveying.Most of the laws that allow surveyors access do not really specify why or how it is allowed. I know one state requires you inform owners. I would say over the years roughly half of the surveys I worked on none of the corners were in place. If they aren’t there you have no choice but to look Bryon on other peoples property.
I can’t say exactly how many surveys I did over the years, probably approaching a 1000 and probably of those we maybe had people get upset that we were on their property less then 50 times. Of those 50 times there was probably 6 times it was a real issue. Most of the time if you tell them what your doing they are ok with it.
Or in the case of my father's property I cited earlier; cutting the cable so that you can drive down his road.
