About a year after we moved into a 215 yo. house, one day the doorbell rang.

A nice older woman was at the door. I said "Yes?" and she said, "you don't know me but I was born in this house in 1942" ...

She was the daughter of an architect who bought the home in 1938 ... and since we were in the middle of restoration and research, she spent the entire day providing tons of important details and demystifying others.

About 1/2 hour into her visit however, she said ... "Say, where's my father's tractor?".

I said ... "you wouldn't be talking about an old John Deere tractor would you?" She said "YES! a 1947 John Deere B. He bought it new and stipulated that it should always remain with the farm."

The week before we closed on the house in 2000, the bozo (another story) of a former owner asked me if I wanted to buy it for 5,500. (It wasn't running). He sold it to a fellow in Maine for an undisclosed amount.

Both of us were pissed! /forums/images/graemlins/smirk.gif

I do not believe that a tractor will legally remain with the land. You may want to obtain copies of the deeds to the property that precede yours and see if there is any mention of a tractor going with the Realty. Probably Not. Write back if you locate any reference to same in Deeds or other communications you may be privy to.

Nice story...sorry about the sad ending. Not that you need the tractor, but history is important. Honor is even more important. Glad to see you have honor, sorry to hear that all don't. Wish I had an old B that I could send you.

A deed restriction to "never let the JD B leave the property may have protected it, but I don't know for sure.

I know I am not allowed to raise sheep or swine on my property, not that I EVER would on my 1.67 acres /forums/images/graemlins/grin.gif

Ha. Our city doesn't allow horses unless you have so much land plus an acre per horse. We have a little more than a half acre, so my wife asked if we could have a burro thinking that that's about half a horse, but the folks at city hall didn't buy it. We can't even have ducks. Something about the fowl odor. We asked about grouse, but they said only if we didn't have a fence and didn't keep them contained. So we gave up grousing about that and we have three dogs and that's it.

I'm glad I live in an agricultural county... Even in most areas where there are deed restrictions.. if your land is A-1.. you are allowed horses and cows no questions asked..
