The rights would show up in a title search. Now if they find nothing they need to plant some IRON in the field. Hay equipment hates old iron :thumbsup::D..Gets real expensive quick. Also fence and lock gates to prevent entrance.

I have doubts the deed is even recorded. Don't really know. They said it's a "Land Contract".

I didn't know any of this when I first posted. I thought they "owned" the place.

Oh, well... I guess if he told them...that's that!

Wouldn't there be a contract or deed, etc.. that lists these rights?

Hey, if no documentation necessary go tell the wimps you own their TV rights and start carrying it to your car. ...or their car, you own the rights to that too!

..or tell them you have "droit du seigneur" ( jus primae noctis) rights & you've finally come to collect. ;) From the sounds of it his response would be "Okay." :confused3:

You made your point effectively. The neighbor also may be in the right though. Under the circumstances it was wise to step back, think about it, and (hopefully) do some research before going forward. If the neighbor is right, an embarrassing situation was avoided. Otherwise, further action can be taken. Sometimes you have to concede a battle to win the war.

If its a land contract, they are probbaly buying it from the people who cut the hay and they reserved the right to graze/cut hay until its paid in full.

That sounds like an unethical thing to do. Cattle can tear up the yard, eat the garden, and damage vehicles and buildings. Hay cutters could cut down your possible crops. I cannot figure out why anyone would knowingly sign such a contract that might run for many many years.

Have a cousin that was deeded property from her parents with them having lifetime estate. After the parents passing and the property transferred to my cousin found out that the property also included lifetime rights to the person that the property was purchased for the timber.

I wouldn't buy any property without all the rights to it. I did much research on this place to make sure everything was clean, including a new survey. If someone else has some rights, other than utility easements, I would have to likely reject the purchase. These things probably have to be disclosed in the deed or contract, but most people blindly sign, which is just stupid, IMO.

I did not know any of this to be their circumstances as of my initial post, but I know now. Here's what Dave Ramsey, the well known financial adviser, has to say about "Land Contracts":

I would never, under any circumstances, ever buy a property on a land contract.

In some places this kind of thing is called a contract for deed, but the problem is you don't have the deed. The property is not in your name. You could easily run into a situation where you've paid the balance down for 10 years, then the guy you're paying gets into a car wreck or another kind of financial trouble and someone slaps a $500,000 lien against the property that's supposed to be yours.

Don't pay for property that isn't in your name, Keith. Land contracts, or contracts for deed, are dangerous for the buyer and just plain stupid!
