I take checks everyday from customers, never had a bad check in 26 years, but I'm getting these checks from home owners for work done on their home. I know it's more risky in a retail environment, but can't someone get arrested for writing a bad check? I'd think that would be a deterrent.

What's cash? I use a debit card or credit card for everything... sometimes I get a few hundred dollars in cash for rent payment and the wife gets tips at work. Neighbor who owns a rental house like me always has problems with bounced checks!

I believe it's a violation of federal law to refuse cash as payment for any debt.

I don't know about that. I have owned apartment buildings and various rentals for 20+ years and our rental contracts have always stated that cash was not an acceptable form of payment.

We just don't want that much cash in the office -- makes you a robbery target around the first of the month.

Yep... went to a auto body shop a few months ago and they had a sign stating for the safety of our employees, no cash transaction!

When I drove for Airborne Express and UPS, we would not accept cash for anything. It had to be a check or money order, sometimes just the money order was the only thing acceptable.

Right after High School, I had a job with Mervyns as a Credit Authorizor. While it didn't have anything to do with checks, it was suprising how many people that were denied their purchase, didn't have a clue what their account was like. Most of those who were suprised where the husbands who rarely used the card and thought their wife had been paying the bill. It was very common for a card to be rejected because of repeat late payments. In 12 months, it wasn't uncommon to see 10 late payments.

Then there was the cards that had a problem reported on them. Lost cards were the most common, but sometimes a stolen card would show up and I'd have the cashier check their ID. It was always fun to hear the person say they had to go get their ID in their car, and leave the store to never come back again.

For me personally, I've had my Debit Card denied several times because the computer at my bank was either down, or the phone line to it was down, or maxed out on capicity. It's a local banck with branches all over the area, but sometimes they get overwhelmed and my card wont work. I'll wait a few minutes and have them run it again. It might take three or our tries, but eventually it's always worked except one time. Then, I used my credit card and found out that the phone lines were totally down all that afternoon.

It might not be Harbor Freights fault, it might be your banks fault, or something to do with the way they communicate. With everything being computerized and instant communications, if it doesn't go through the first time, it just denies the transaction. With thousands of transactions going on every second, sometimes it doesn't happpen.

Good luck,
Eddie

im wondering what "This note is legal tender for all debts public and private" is supposed to mean.

I believe it's a violation of federal law to refuse cash as payment for any debt.

Ditto that...

If you offered and were refused... consider it a gift... at least that's one Law School Professor did... he made a Federal Case out of it...

Here's what the US Treasury has to say:

U.S. Treasury - FAQs: Legal Tender Status of currency

"I thought that United States currency was legal tender for all debts. Some businesses or governmental agencies say that they will only accept checks, money orders or credit cards as payment, and others will only accept currency notes in denominations of $20 or smaller. Isn't this illegal?

The pertinent portion of law that applies to your question is the Coinage Act of 1965, specifically Section 31 U.S.C. 5103, entitled "Legal tender," which states: "United States coins and currency (including Federal reserve notes and circulating notes of Federal reserve banks and national banks) are legal tender for all debts, public charges, taxes, and dues."

This statute means that all United States money as identified above are a valid and legal offer of payment for debts when tendered to a creditor. There is, however, no Federal statute mandating that a private business, a person or an organization must accept currency or coins as for payment for goods and/or services. Private businesses are free to develop their own policies on whether or not to accept cash unless there is a State law which says otherwise. For example, a bus line may prohibit payment of fares in pennies or dollar bills. In addition, movie theaters, convenience stores and gas stations may refuse to accept large denomination currency (usually notes above $20) as a matter of policy"

If they say they take personal checks, it's not there business to check your balance, you might be making a deposit later that day,

Can't count on that nowadays. Many businesses have that electronic check reader thing that debits your checking account in minutes.
One of my sons learned this the expensive way, paid his rent and was going to deposit money to cover it later that day....rental company had the money, or rather tried, to get the money out of his account before he got out of the parking lot. Cost him over $100 in late fees/bad check fees etc. Used to be it might take days to clear the check and he'd have been ok. Not now if they use that machine.
