what is the date that the dealers must reply to textrons charges----20 days to reply for those 8 or 9 cases what is that date----Blue----Dark Shadow ---Longtractorman---taxpayer anyone know the date and how to look at those cases without having to pay the state of RI or their PACE system they say the case file is only 20 to 30 pages at this time ----can someone post the links and how to access these pages?????

This is all we know and it is public information. No one who is being sued is going to say anything for fear of trashing their hope of a fair outcome of the court case. I don't have money to get the Pacer software and I won't be going to Rhode Island so I guess I'll know when you know.

Largest Verdict for Fraud Ever Rendered for Deception Related to E-Z-GO Golf Cars.... - Auto News from July 11, 2007
LOS ANGELES, July 11 /PRNewswire/ -- Stephen Jamieson, a partner in the law firm Solomon, Saltsman & Jamieson based in Los Angeles, California, in association with Tom Ward of the Lancaster based law firm Michelizzi, Schwabacher, Ward & Collins, obtained a Judgment for Fraud against E-Z-GO division of Textron, Inc. also known as TEXTRON INC this month. TEXTRON INC., a multinational defense contractor that is traded on the New York Stock Exchange under the symbol TXT is ranked 190th on the Forbes 500. Ryan Kroll, an associate at Solomon, Saltsman & Jamieson assisted Mr. Jamieson.

A twelve person jury decided a verdict in favor of Ridgetop Ranch Properties, Inc. dba Lake Elizabeth Golf Course (LEGC) on claims of Breach of Express Warranty, Breach of the Implied Warranty of Fitness for a Particular Purpose, Fraud by Intentional Misrepresentation and Fraud by Concealment. "The jury was clearly convinced by the evidence produced at trial that TEXTRON (E-Z-GO Golf Cart Division) committed Fraud," explains Stephen Jamieson. "E-Z-GO tried to hide behind limitations in its printed warranty but was not allowed to do so."

According to the lawsuit: the 80 E-Z-GO TXT golf cars broke down, failed, or were inoperable on a weekly basis, rendering numerous golf cars unfit for use; that while E-Z-GO was stating to LEGC that the golf cars were not defective for use at the Course, E-Z-GO was nevertheless at the same time seeking reimbursement and credit from the speed controller manufacturer, Curtis Instruments Inc., claiming the speed controllers used on the TXT golf cars were defective and/or unfit for use; and, that E-Z-GO concealed these and other facts from LEGC and went on to replace the failed speed controllers with similarly defective controllers.

Due to the continual breakdowns of the E-Z-GO golf cars, LEGC gained a reputation at that time as a course that was unreliable and dangerous, thereby suffering a tremendous decrease in the number of golf rounds played which caused a decrease in profitability and a diminution of value of the Course. The jury determined damages caused by E-Z-GO to be $1,670,932.00, plus Costs, and 10% Post Judgment Interest.

Taxpayer-----Hope they get your check mailed before the post office goes broke---guess you can take a boat ride and pick it up------SHOW ME THE MONEY!!!!----sure looks like a pattern has developed----reckon some of our "friends" that have defended Textron's business model want to buy a few slightly used golf carts!----what was that stock price again---hope it goes to $100 per share so they can pay all you guys and the lawyers----------no affect?????----not what i am hearing-----:rolleyes: them there dogs sure are barking loud!!! reckon they got a hog are a pole cat in a corner???? any more new "suits'?:eek:

Gotta chuckle: Hiring an EVP of "special assets"? They way they've lost money, being assigned to anything asset-related is equivalent to a day's worth of free highspeed Internet surfing at work.

Maybe Mr. Cohen is selling a few collector TFC emblazoned napkins or Coca-Cola bottles on eBay to help offset their deficit.

Textron hires vice president

Providence-based Textron Financial Corp., a Textron Inc. company, has announced that Stewart L. Cohen has joined TFC as executive vice president of special assets. Cohen, who has more than 20 years of experience in asset disposition, is responsible for the orderly liquidation and selected sales of certain of the company痴 commercial finance assets.

His hiring supports the company痴 strategic mandate to restructure its business, Textron said. Cohen most recently was executive vice president of the Hilco Organization, focusing on corporate acquisition, asset disposition, special-situations financing and consulting activities across all industry sectors. Prior to that, he orchestrated the wind-down of Polaroid, and he previously founded and managed Paragon Capital.

Tax----looks like SC will be on his way to pick up those "special assets" and dispose of them properly---wonder if they are going to sell them to M on credit???----heck with a "good discount" the tractors dealers could do his job alot CHEAPER!!!!----What does vp's make these days $5000-$10000 dollars a day???? :D---be sure he has paid all those storage fees before he leaves the lot with those "special assets".:cool:

Hello, all!

In response to requests to follow the case without the costs incurred by Pacer documents, I've provided links to a few HTML documents.

I realize they are not a wire-to-wire account of court happenings and apologize that more aren't available -- at least not yet. Hopefully the HTML docs are a stopgap. They should provide an overview of the events that've occurred, deadlines and their respective dates.

Note: The three cases are only a few of those in effect and being used to illustrate the process. In no way am I singling them out. [*Someone's* documents were necessary to illustrate the events that are occurring!]

An aside: This case is such an administrative beast to follow. It's sheer density combined with its bredth can be a bit overwhelming. It makes me feel for folks that're trying to run a business and concurrently give the proper treatment to these issues -- grave legal matters that, for most, are likely the breaking point of their businesses.

In contrast, I'm a writer with other, unimpacted employers ... and *I'm* struggling to keep pace with this. I've gained even greater empathy for each retailer's plight.

A small comfort: Please remember that our hard-shelled friend, the tortise, plodded along with focus and humility ... and defeated a more spry, talent-loaded hare. Folks, I believe our lot is the former.

I am interested in the Oakboro case:

The case was reassigned to Judge Lisi because it was not similiar to another case (I believe Zinni etc). Is there further info on that. I don't recognize the name--perhaps I'm looking at lawyers names?

the american way 5 lawyers against one----what do those city lawyers make $400-$1000 per hour------400 x 5 equal $2000--$1000 x 5 equals $5000---wonder how much discount they could but on each blue collectable and save money----I know lawyers have to make a living too----how about weed eating at the local golf course----pay'em $400 a week----and we wonder what is wrong on wall street-------:confused:-----someone turn the dogs loose----it is time to get even----and educate those "uneducated folks" on wall street----just common sense would solve all these lawsuits-------it is about winning it ain't about the money as the math will prove!!!!!

can you believe those city lawyers---They think they can write contracts that state that the buy back laws (State Law)do not apply to them----wonder what kind of contract they have with the IRS(Federal Law)----and their ability to over state profits and losses---------sounds like FRAUD to me!!! got to love that PACE machine it is better than the paper at Dairy Queen!-----:) How many counter "suits" NOW?????----remember I will have some boats to sell----:rolleyes: BIG BOATS!!!!----MAIL FRAUD---WIRE FRAUD---is that some kind of new disease on the east coast!!!!:confused: sounds like someone let those country dogs (lawyers) off the chain they are going to eat up that there pole cat---or is it just a big tush hog with its teeth clipped-----cooke-----d pork sure smells good!!!!

okay,
I have read the entire thread from start to finish much to my amazement. I started reading to determine whether or not I wanted to buy a 360 DTC from a local dealer that is changing over to LC Mitron when they are available. this is my second tractor and want to get something that I can source parts easily. It seems like LC is going to support the FT tractors; however, do I really have a warranty at this point?
