I just re-read my original post, I didn't make it clear that he is intending to pay for this on his own, he had it in the shop and diagnosed prior to calling me and telling me what was wrong--that way no guessing and such on either party's part as to what might be broke.

As for the ballast I didn't send it as I didn't think heavy stuff was being moved---had I known that I would have sent it with the tractor.

Sounds like he stepped up and did the right thing. Hard to fault him here.

If it was me, id likely split it with him, because he did the right thing. If he didnt volunteer, my opinion would likely be different.

There's no way I'm going to pay $500 or more for the privelege of having my neighbor break my tractor. Sorry, that's just the way I am.

Then its probably not a good idea for you to loan your tractor. I would rather go and do the work for my neighbour myself so something like this discussion doesnt need to happen.

What if you broke your tractor at your neighbours? would you expect him to pay the whole shot if you were operating?

The guy did right in this case, and theres no guarantee that the axle wasnt damaged when he got it. THe fair thing is to meet him halfway at least in my opinion.

Now if he dropped a tree or something on it.. id expect him to foot the whole bill.

That's something I figured out years ago. It's usually not a good idea for me, or anyone else. That's how guys get in these situations. The borrower should man up and fix the tractor, as he is attempting to do. He's doing the right thing.

No, if I were operating it, I would drag it home and fix it. It would not matter if I was charging for the work, or doing a favor; I broke it, I'd fix it.

I agree with most of what you say. Only place we differ is splitting the cost.

How heavy of a load are we talking. Doesn't sound to me like the thing should have broke in the first place, even with out the ballast.

What all do you get for $1200?

I just spend $650 replacing some u joints, yokes, dipstick, etc on my batwing from hitting a stump.

ACS: you said you were going to maybe have the rear seal fixed too. Here's a compromise suggestion for ya to consider: Maybe, since you were going to have that rear seal done, and you'd have to have it hauled both ways ( I am assuming you or your neighbor did not haul it, considering the liabilty and weight), he's planning on paying the repair, so you offer to pay the transportation costs since you have the rear seal done now too, and anything else you feel it needs.
I know if I borrowed the tractor and broke it, I would pay for repairs. I have a neighbor's disk setting in my yard right now. Sure enough, as soon as I started using this borrowed disk a bearing went out. I bought the bearing, and the owner (of the disk) and I are going to do the labor together. Never a question about it: I broke it, I pay. If I need the disk again, he will loan it to me I bet.
sometimes it helps to look at the other side of the coin.
