Why can not she sue the city for allowing the danger to exist so close to her property? But as close as it is to election...get the TV media out there. :)

i think the media is an excellent idea......this is government at it's worst....slow, inefficient, held to a different standard, etc....

for once, i think the media could do well, here!

It is a real sad thing but I have come to believe that there is the seed of a bureaucrat in each of us and it only takes the wrong position to let it grow. I really hope each of you will fight it off as best you can. :(

He's saying the bureaucrat's are people too and that if anyone here is ever one that they remember how it is to try and wade through government red tape.

MP, it matters not to me what was meant by the comment but was impressed you got all that from Snowridge's comment. I thought maybe he meant the use of the media. kt

No where in the post Snowridge was Huhing was the media mentioned.

I'm awestruck you got any reference to the media from the 3 post before yours.

Yup. But it isn't just government there are bureaucrats everywhere. :(

The cool thing is if you can break through their bureaucratic shell there is a human being inside. That's the trick.

As much as we'd like to sometimes, you can't sue somebody over perceived or even real danger. To sue them, there needs to be some loss caused by the danger. If there is an accident or fire, you have to show they were informed and were derelict in their duty. For example, you can't sue a gas company because you smell gas, but if you have called them repeatedly due to the smell just before your house blows up, you might have a case.

Unfortunately, fines for code violations only go one way. You can try to get the media to help, but I think I'd write a letter to the editor of a local newspaper too. Sending a certified letter with return receipt is also a good way to document your position. Becoming a constant annoyance is sometimes the best means of motivating a bureaucrat.

Also it might be worth your while to talk to your elected representative. Sometimes they will help and sometimes not. This seems like a case that is worth some effort. It is nice of you to get involved. I hope it doesn't give you too much of a headache.
