Even buying from a dealer may not be perfectly safe. Tractors have become so expensive now, they SHOULD have titles just like cars and trucks.

Even back in the 50's tractors cost more then cars,
And as far as buying from a dealer being safe, their have been several incidents of dealers going out of business and defaulting
on their floor plan financing leaving buyers in financial limbo having paid the dealer and then a bank coming after them as they
hadn't been paid by the dealer.

I got an issue with a tractor now that is tied up with attorneys, banks and the attorney generals office.

It is a 525 Cat Skidder, left when the logger who was cutting on me got done cutting wood, and never paid me. He cannot afford the skidder payment so intended for it to go back to the bank.

Unpaid, I had my attorneys put a Mechanic Lien on it, and under Maine Law, people holding mechanic liens have first rights to any property. This puts it in serious limbo because it is worth about $22,000 and yet the guy only owes me $15,000 or so. It will take me about 3 years for the restitution to work through the court system, but I could sell the skidder cheap and get my money a lot faster. I just need a clear authority to do that. I have ZERO interest in the tractor...it is a Caterpillar after all :)

As for storage fees, I figure $20 a day is about right. It has been sitting here since March 21st 2018.

Hopefully that will work out for you, and enable you to collect your money faster. At least you have some leverage. Even if you do get a judgement it could take years to collect; and all that they need to do is declare bankruptcy to get out of it. ,

Though I am sure the Deere dealer who reclaimed its stolen and depreciated tractor is under no obligation to do so, it would be nice if they sent you a check for 50% of what you paid at the auction, along with a THANK YOU card.

If the auction doesn't pay up, and you have a judgment, when they plan for next year's auction, try to get an injunction to stop them from having it.

We haven't made any decisions. Incredibly busy this time of year, and might not want to make any decisions until we get this issue resolved anyway.

One advantage of choosing the Kioti would be that we already had a name picked out. ...but I see your screen name beat us to it :)

That is quite a story, and hard to believe. I hate to hear about stuff like this happening to good people. No question this is on the auction house -- they really blew it.

This was a charity auction. Small town. No one could image such a thing.
They have only one auction per year, to raise money for the Ruritan Club to operate throughout the year.
The Ruritan club did the check-in for all of the tractors and equipment.
The auctioneers were donating their time...on the day of auction only.

Please understand that many of the Ruritan Club members are neighbors and friends of my family for several generations. All local farmers.
So, this is incredibly difficult situation. It is pretty clear that the responsibility lies with the Ruritan Club (or the Auctioneer, not sure), but we are trying to give them as much time as possible to 'come to their senses' before we formally file suit.

Believe it or not, we have no hard feelings, as there was no ill intent by these groups. We just want our money back (and now, our accumulated legal fees).

Tim, you are being a real gentleman about this and I understand it's a tough situation with the club, but it's sad that you are the one that is out of money in this situation. Not the criminal, not the criminal's girlfriend, not the auctioneer, but instead the well-intending and honest buyer. Really, the only party that did nothing wrong and was honest, is the party that loses. That's just wrong and I hope somebody else with some responsibility steps up and gives you your money back.

The club is giving itself a bad reputation. Misappropriated funds garnered from selling stolen equipment that should have thrown up red flags upon even a cursory inspection (grinding marks, no plates, etc).

It wasn't a legitimate legal transaction in the first place - the auction house (as agent for the seller) or the seller had no business selling it to Tim. Tim should get his money back when the dust settles.

It seems he doesn’t really want to do what’s necessary to recover his funds out of concern for offending friends and neighbors. Nice guys rarely win in the dog eat dog business world.

I have seen too nice landlords taken horrible advantage of by deadbeat renters. Then they never learn.

I suppose if he maybe wants to donate the 14 k to that charity, that would be fine if he can afford to do so. Write it off as a business loss.

You have jumped to conclusions in both of your recent posts "I guess he can take that kind of hit..." and "he doesn't really want to do what is necessary...". Both of those are inflammatory statements which do not accurately reflect what is going on.

It takes time to work through things like this. ..and it sometimes takes a bit of deliberation and maturity. If we don't get results with the approach we are taking, we are definitely willing to take the next step.

I've not been involved much with TBN. Perhaps this is just how folks treat each other over here. ...but it certainly doesn't feel very friendly.

Sounds like you are level-headed and handling the situation properly. Best of luck to you, and I hope you get as much of your original purchase price back as possible.

Agree. I have found TBN in general to be very friendly to inexperienced users. Some people (John in this case) don't read much of the information you have given and/or are jerks.

I have enjoyed your YouTube channel and sharing this experience will hopefully save someone else in the future. As this thread shows buying from private sale/auction/dealer is not fool proof. Can't trust without some verification.

Tim you have a nice channel where like a few others Kapper and Morgan come to mind that help accelerate my learning curve.

We have the same type of personas over on the tundra forums....so don't be dissuaded by the few.
Albeit I'm guilty of saying stupid stuff under the color of humor but later reflections make me ask...what was I thinking.....so hang out and share your experience.
