LMTC, I do like your attitude and wish your views were more widely held. There are all too many people who don't give a hoot about their own safety or those working with or around them but worse yet ridicule safety precautions taken by others and practically mount crusades against all the "Nervous Nellie Hand Wringers" (as they characterize anyone with reasonable concern for safety.)

An implement dealer is often the first and sometimes the only contact a new impressionable tractor owner may have in his early tractor habit forming period. If the dealer poo poohs safety it will leave a lasting impression on the customer which may very well last a lifetime (however short.)

If I flip my tractor & get killed cause I had the ROPS folded down. Can my wife sue because the ROPS should have been welded straight up so I couldn't fold them down ??

I'm joking of course,:D but I'm sure this has happened. I see folkes operating their tractors all the time with the ROPS down. I don"t & wouldn't operate my tractor with the ROPS down . I always use the seat belt.
