The amount of chemical shouldn't come into it. Should be figured on the same basis as using a weapon, i.e., brandish a fake gun in a robbery it is 'armed robbery' weather it was fake or not.
Same as self defense. If the victim 'thinks' they are in danger (and can convince the DA of it), they are in the eyes of the law.
