I agree, I hope the teacher is speaking to the DA. On the other hand the amount of chemicals in the water could have been miniscule and not meet the standard for a higher charge. The papers usually leave out the important details....

The amount of chemical shouldn't come into it. Should be figured on the same basis as using a weapon, i.e., brandish a fake gun in a robbery it is 'armed robbery' weather it was fake or not.

Same as self defense. If the victim 'thinks' they are in danger (and can convince the DA of it), they are in the eyes of the law.

But the amount of chemical might very well be a factor. As well as the punks intention. Generally DA's try to go for the maximum that they can in high profile cases.

The law can be weak in some areas as well. NC just upped the penalty for strangulation. Until this year you could put the squeeze on someones neck and it was NOT a felony. If you do the same thing this month that was done last month, it now IS a felony.

The origional charge may also have been done by the officer or only allowed by the Magistrate. If the DA has a case I'm sure he will up the charge.

I certainly THINK the punk should have a higher penalty but that may not be what the law allows.

A good teen age boy is ornery by nature,,,,most old fashined things worked pretty good on them,,,this newer time out stuff,,taking their cars and computors away,,,just shows you how screwed up we are,,,you got to make a teen fear you to some extent,,,you might not ever have to whip him,,but he's got to know if he makes you mad enough there is a least a possiblity he could die,[in his mind],,,,hard work helps,,but most teens live on 1/2 acre nowadays with the only chore they got is taking out the trash,,its how you raise them.
Having said all that,,there ain't no need,does more harm than good,throwing a ornery teen in prison,,for something stupid like this,,,make him work putting new posts and boxes in,,,make him sell his stuff to pay for this,,,if he don't want to,,than after a night in a regular jail,,he will come around to your way of thinking,,,,we need the draft back too,,to many spoiled rich kids out there.,,thingy

Speaking of punishing kids, we too believe in spankings, but only on a limited bases and as a last resort. Time outs are very common with us. First they stand with thier forehead on the wall, then it goes up to laying on the bed for a certain amount of time.

The one we've found the most effective and painful to them is to take away a bunch of there toys. The sobs are very real and it really gets the point across when we take a full box worth of stuff.

Biting a bar of soap has also been very effective when one of them decides to get mouthy. So far it's only happend to each one once. I'm curious if they learned that lesson or not. I only had to bite the bar of soap one time when I was a kid too. Lesson learned. hahahaha

Eddie, something else you may want to use. Take away the TV or the video games. You don't strike me as the kind of parent who would give the kids a cell phone, but taking that away is a very effective discipinary measure.

I deeply am sorry for having done the same thing back in the early 70's. When we were caught the local sheriff gave us no choice, we replaced all blown up mailbox's that day with a certain kind that he picked out.He then gave us a good talking to and called all parents to do with us what ever they saw fit.As some one already said THE FEAR OF GOD! Lesson learned for sure.

Making the explosive is a stupid but part of the experimental, exploratory, human nature, particularly in a young person who is learning from everything they see and do.

Taking that explosive and placing it in a mailbox, is a thought out (well thought, or poorly it is planed) malicious act of aggression and needs to be dealt with in a serious manner.

If the kids were out detonating the soda bottles in their backyard in a hole in the ground, then I would say busting them is a bit much. But when they decided to take their adventure out into the community, they crossed the line.
