Kind of like saying a loaded gun should be illegal because it "CAN" kill someone.

No, sort of like saying that if I stand at the end of my driveway randomly shooting down the road, it's OK as long as I don't kill anybody.

Laws are enacted for one of two reasons; because some people feel the need to control others, or because some people don't know how to act responsibly enough to keep from endangering others.

Often the last group of people give the first an excuse to have their way.

Or an unloaded gun CAN be loaded and then CAN kill someone.

Apples to oranges. Somebody still has to handle the gun unsafely, or intentionally point it at somebody for it to cause harm. With the grossly overloaded trailer that unsafe act is already been committed; the operator is trusting luck to get him home safely.


I don't believe in luck.

It's hard to prove a negative. If it didn't happen how do you know it was unsafe? Just because you deem it unsafe doesn't make it so. Even if the law is technically on your side it doesn't inherently make it unsafe.

I just think, if someone hurts or kills somone whether it be with a firearm or improperly loaded vehicle, THEN throw the book at them. Make an example out of them for others to see and learn from. Until then, just leave people pretty much the ##$# alone! ALL these people that just like to CONTROL others! Nanny state, Police state, whatever.

I agree with this. Unfortunately there are far too many people who want the nanny/control side of things. :-(

It really boils down to the opposing philosophies of either hold people responsible if/when they cause problems or put up guiderails such that nobody can ever cause problems. I'm of the believe that if you do the former it will eventually train folks to self-regulate enough to not be a major issue.

Weight ratings et.al. aren't just pulled out of the air; they are there for a reason. Generally they are conservative because they know people are going to exceed them, yet they are based on engineering and science. If you put 4 tons on a 2 ton trailer you are pushing the limits. If you know anything at all about hauling trailers, all that you have to do is look at that picture to know that he's either overweight or is improperly loaded. Would you like to have him following you through town?

I stopped into a former coworker's house, who had just pulled in pulling a dump trailer with 3 yards of stone behind his 1/2 ton company pickup. Load and trailer weighed over 5 tons, plus the 5500 lb truck; and he had just come through the town of Houlton ME. No trailer brakes, just what's on the truck. Yet nobody was killed, so do you think that was OK?

As the poster above me points out idiots abound; that's why we have so many laws, because some people don't know any better.

All that you need to do is look at the highway fatality rates in countries where they have open laws as some of you seem to agree with, to see why self regulating doesn't work... at least until all of the "idiots" are killed because of their stupidity. Usually they walk away though, after somebody else has paid for their mistakes.

Not only about controlling others. When it just happens to generate revenue, man, you are really on to something.

I always have to think of that video I saw in Russia of the dump truck missing a front wheel going down the highway, with it's box raised to change the COG and take weight of the front axle. Good bet the driver was drunk too. Or another picture stuck in my mind from Mexico, with a pickup heading down the highway with a bunch of (very) young kids standing in the back.
