eBay does not allow copying of auction text or photos.
You will find their policy here:
http://pages.ebay.com/help/policies/vero-image-text-theft.html
You can also report the problem on the page at the link above.
With the 10's of thousands, possibly 100's of thousands of listings, it would be impossible for eBay to check and cross check all of them.
I have been an eBay member since 1999. I have had powerseller status and I am a registered trading assistant with them.
My personal advice on protecting images is to get and use a program like MS Paint (found under START/ALL PROGRAMS/ACCESSORIES/PAINT on windows machines)
or
getting IRFanview....a free little image editor found here:
http://www.irfanview.com/
Either program will allow the placement of text or a trademark over your photo(s). That way, the copycatter, if dumb enough to use your photos, will not be able to hide the fact that the photos are someone else's.
I have had others try and use my images....even with my name on them, BUT, having my name on them makes it easier for eBay to see and understand the images were mine and not the copy cats.
One great place for assistance with this problem is their Trust and Safety discussion board found here:
http://forums.ebay.com/db2/forum.jspa?forumID=107
or the Policies-User Agreement discussion board here:
http://forums.ebay.com/db1/forum.jspa?forumID=100
or here on the Photos & HTML board:
http://forums.ebay.com/db2/forum.jspa?forumID=99
There are dozens of boards in all to assist members that you may find helpful here:

I hope this offers some insight and assistance on how to stop the problem of text and image theft.
