the dealer may have messed up on the insurance requirement & waived it. it's all in the signed docs. if so, he is liable. K central needs to be brought in. wouldn't do any agreements w/dealership till K central is in the loop

If the dealer failed to obtain proof of coverage at the time of sale, Kubota credit might have followed up with a default notice and charged for forced-placed coverage. Will need to look through the entire paper trail on this machine.

Please be careful not to underestimate the severity of skin burns. I had a family member suffer a severe burn. Thought they'd be asking to go to the hospital, but they weren't even though it looked like the pain had to be terrible. Turns out the burn was severe enough that the nerves were also damaged so they weren't signalling pain. Ended up taking them to the ER. The burned area wouldn't heal on its own, either. Required plastic surgery and a skin graft.

If the dealer starts asking you about the severity of your burns, be careful what you say, especially if you haven't obtained proper medical attention.

You have a potential warranty issue, insurance coverage issue, and personal injury issue for which you may want to seek proper legal advice.

I was looking to finance a Kubota last year and the dealer was adamant that insurance was included in the finance to the tune of $56 a month with no exception and no way around it! If you want finance you get insurance. Because .........this.

How is he liable? If the damage was done by fire, not usually warranty. If customer didn't want or pay for insurance, the risk is born by the customer for passing on insurance.

The dealer may hold sales/finance guy accountable for not selling the insurance as it makes them $$. That doesn't help the customer though.

Maybe. Don't get your hopes up. Most likely cause given known info so far is a fire due to screen being clogged during/after cutting. Hot engines and dry grass = fire hazard.

Definitely get medical attention, but unless you can prove it was a design flaw (onus on the plaintiff) or part failure it is just a tragic accident.
