No it isn't safe, the guy on the left shouldn't be using a mobile phone on a work site ....even if it is to chase up the fluoro vests/PPE for his crew, a Stop/Go sign to ensure adequate traffic control & an operator with working at heights certification to drive the backhoe....................so much for a risk assessment....
