Looks like the wet weather has slipped to Saturday, but we'll still get several days of mild rain out of the next storm.
So let him try to fix it and call in MDOE if it fails or

and let him go through the new permit process?
Has he received a "Cure Notice" sent registered mail from you? That would be your first step in the legal direction. Then if he continues to ignore it, contact the zoning/building department and file a formal complaint. If that is ignored, file a lawsuit in small claims, or if over the small claims limit, hire an attorney and file in superior court. Just make sure you track your time and expense in making any repair to substantiate your damage claim. I don't believe you can sue for emotional distress in small claims, but you can in a higher court if damages are substantial. Unfortunately, the higher the legal escalation, the more it will cost you before any satisfaction is obtained. And even if you get a judgement against him, you might well have to spend even more money to collect it.
There are some pretty sad tales floating around here on TBN about neighbor issues. I hope you can resolve the problem quickly and inexpensively, maybe with just a letter from an attorney.

Thought I had unloaded all the boxes, but I forgot about the ones that came down in the Camry. One had a bunch of bananas, and it's been sitting in the car since last Thursday. Now they're very ripe, but very sweet, too, just the way I like them. I knew I'd packed all my tableware to bring down, fully expecting a box from the trailer or van to contain it. I unpacked the Camry boxes this morning, and there it was. Now I'm washing the tableware I was using, a mish mash of old cutlery and my camping pots'n'pans. Serviceable, but not as nice in your hands. More incentive to get the move done and someone else in that house up north.
Installed four TapCon screws in the toilet flange yesterday, but didn't torque them very tight, having no experience with either the screws or the plastic toilet flange. Better safe than sorry. Should the rest of the install done this afternoon.
