Ok, I misunderstood you. Let's rephrase. IF they build a new fence, can I make them leave mine in place? If you say no, why must I let them on my land? They want to clear out the tree growth that has occurred to build a new fence.

Questions before I answer.
Is your fence on your property proved by survey markers? How do you intend to make them leave it in place if it is on the property line? Do any of the tree branches extend over their property?

Looks like you are heading to a good strategy. Instead of the neighbor expecting you to pay half he will be grateful for you to grant him permission and allow him to clear out and construct new.:thumbsup:

It all comes down to what the laws are in your jurisdiction. Here, there are laws on the books that prevent neighbors in certain zones from complaining about farm activities. My place isn't fenced, and I've chased cows off from up the way; there's nothing on the books I've been able to find requiring the rancher to maintain his fences. I can see why your neighbor would want to clear the right of way for the fence, as it would make maintenance much easier. But that's a benefit to them, not you, and if removing the growth impacts your privacy, it seems like you should be compensated in some way. Or he's just gonna have to get used to plucking tree branches off the fence, and repairing it after a wind storm.

Is the existing fence right on the property line? If so, it's probably better to replace it with a new fence also right on the property line. That way there's no confusion as to where the property line is as properties are sold. That'll make more work for the neighbor, but he's benefiting by being able to keep his cows where they belong, and benefiting again by being able to profit from raising cows. Unless there are laws on the books about farm nuisances like the ones out here, you deserve to be compensated if it means you're subject to unpleasant smells, flies, and noise from his ranching operation. Sounds like a come-to-Jesus meeting between you two would be an opportunity to educate him on your concerns, and if you do your homework, what laws are applicable. That'll require some effort on your part, but the benefit to you is maintaining at least a working relationship with your neighbor. And that's a he11 of a lot better than having them be a constant source of irritation. DAMHIKT

Finally got around to watching the Forks Over Knives movie. It presents a strong case for plant based diets. No surprise there, but I'm not likely to make the switch cold turkey.

What's your favorite plant based cook book, Don? I can see myself gradually incorporating meatless meals to the point where the majority of my days are void of meat and milk proteins. But I don't think I'll ever be able to kick the BBQ addiction.:licking::laughing:

Of course we have a HOA and I love it. Before we seriously considered moving here we read every word and there were no deal breakers in it. The HOA keeps the neighbors to our standards.

The people who consistently have problems are those who lied at their closing when they sign that they have read and will abide by the HOA covenants. If they don't read them and have a problem with them later they should move.

In LS situation above our HOA states
. . .the (neighborhood) is intended to provide housing primarily for persons 55 years of age or older, subject to the rights reserved in section 11.11. The properties shall be operated as an age restricted community in compliance with all applicable state and federal laws. No person under 19 years of age shall stay overnight in any dwelling unit more than 90 times in any calendar year.
Section11.11 each Dwelling Unit, if occupied, shall be shall be occupied by at least one person 55 years of age or older; provided however, that once a Dwelling Unit is occupied by an age qualified Occupant, other qualified occupants of that dwelling unit may continue to occupy the dwelling unit, regardless of the age of termination of the age qualified occupant's occupancy. Notwithstanding the above, at all times, at least 80% of the dwelling units within the properties shall be at least one person 55 years of age or older.

If anyone sees a situation where they might have a grandchild under 19 have to live with them more than 90 days a year why would they agree to the above?
Now I think you read something into my answer that wasn稚 there. I referred to my experience, not yours or anyone other. Our HOA was poorly organized and didn稚 keep their end of the bargain, along with massive yearly increases in fees, didn稚 keep the grounds properly and failed to build the promised swimming pool. But it soured me on the system.

RNG the developer still has the controlling vote until 80% of the planed houses are built, about another 5 years - it's in the covenants we all signed off on when we bought. The developer is probably more receptive to the residents desires because a happy neighborhood sells houses. Two weeks ago the developer was going to add 8 pickle ball courts in a nice quiet wooded park at no charge to the HOA. They surveyed the area in a park where the trees would be removed. People saw the marked trees that would not be removed and within 2 days 1900 signatures were on a petition and the developer quickly nixed the plan and is looking for a different place. Overall everyone I've spoken to seems to be happy with the HOA because they are receptive to the community wishes and works with them. I saw where one person was mad about the pickle ball court proposal and posted on a social media site that the president of the HOA was not a resident was mad and was going to move. Good riddance to him. Apparently he lied at closing when he signed that he read and will comply with the covenants. Being mad about something that is clearly spelled out when you buy is just being ignorant.

On the new trails the HOA is working closely with us and the surrounding houses where the trails will be located. Next week our trail blazers will have a special open house and have a special tour with aerial view maps for the closest houses to the new 3 miles of trails. Trail blazers have finished the rough cut pathway and will be getting input from the residents before the developer makes them final and smooths them with mulch and gravel and bridges.

Time to walk the Whip. Then I still need to solve the compressor mystery.

Randy, got it. Some HOAs are poorly run and don't deliver on promises. Was it an age restricted neighborhood. I found the people here, since most are retired, do a ton of volunteer work for the neighborhood and want to keep it to a high standard.

I saw the "Forks Over Knives" (food over surgical knives) movie at a movie theater special showing when it first came out 7 1/2 years ago. It was a couple of weeks after my heart attack and things fell into place after seeing that movie. A lot of question were answered. I asked my cardiologist about it and he did not see it or think that diet could help. He was so wrong but he did save my life by stopping my heart attack by inserting a stent - I was going quickly. I was grateful to him but still fired him. I no longer needed intervention I needed a cure and he did not have a clue. Things are changing slowly and the plant base cure is finally getting a foothold with results.
