Personally, I'd be helping back up the pipes and letting them washout. (Lowest cost option to yourself) Once they wash out a couple times give the DEP WQS a call everytime and tell them the road failed. They will be issuing NOV's because of the E&S issues the washed out pipes created. Someone didn't do their homework for the drainage area and SWAG'd a pair of pipes in based on the company footing the bill. Id be willing to bet its a small time operator as well.

The issue is being caused by a change in the roadway that was permitted by the DEP for oil& gas activity. They most certainly would be helpful in the situation because its an E&S issue. If you didn't permit the roadway or install the pipes what grounds do you have to support this claim other than generalizations? I worked with the PA DEP for years with these types of issues. The entity that filed the permit and completed the work is 100% on the hook for the issues they caused. They are not coming after the landowner for a gas well road issue. I'll put money on it.
