In May I ordered a new Mini Excavator from the shop I've patronized for 36 years. While they didn't have one in stock the salesman said he would locate one... 2 days later he called and said he had one incoming from another dealer, but it was lacking the quick coupler and bucket and that he'd have to order them.

Several weeks later and after the mini was delivered to my dealer, still no bucket and QC. I knew one of their other dealers had a similar machine and I asked if he could rob those so I could take delivery. He agreed.

I went to the shop on a rainy day and asked if they would get the key so we could check the hours on the machine, I watched the dealer put the key in, turn it, look at the display and he turned to me and said there were no hours on the machine.. (??)

The bucket and QC finally arrived, several days later (2 days ago) they delivered the machine.. I was absolutely shocked. The first thing I did was put the key in, toggle to "hours' and check the meter, 7.1 hours (not the zero i was told when I was at the shop). The machine was beyond dirty. Here are just a few pics I took and sent to the sales guy, zoom in and take a hard look at the filth on the zerk fitting (most were like that), the tracks, the engine compartment was filthy and looked like it was 20 years old, and when I put the front door down under and seat I couldn't believe it. I called the sales guy and told him to have the driver turn around and come get this POS and bring my check back. He suggested he had no idea the Ex was in that shape and stated that it looked like a demo unit.. 30 minutes later and machine is gone after waiting months. Now 2 days later, absolutely no follow-up contact from the sales guy or dealer.

I now believe there was no original bucket or QC cause they showed wear from use, and there's no way they did a DX on that machine w/o knowing its hours or condition. And no one from the dealer even put eyes on that machine, they just shipped it to me like that? I call it a shady, BS deal.

Of course what I want is hard to find, none locally, with months wasted, my hunt continues.. Also, there was a finance promotion that I was going to leverage to finance half the machine at 0%, that is now gone...

I'm just a homeowner with a couple of acres. I purchased this because I can, and I take pride in everything I own. I told my wife that even if they took $10k off that machine (which they NEVER would) I didn't want it. They completely ruined my new buying experience and that if I kept it, every time I looked at it I would remember the disappointment from delivery day.

So let me get this right. You had what you wanted except that it had a few more hours on it than you were expecting and it was a bit dirty. And now your complaining that you can't find a perfect example of what you want for the financing you want and it's the dealers fault. And from your description the dealer went out of his way to get you what you thought you wanted. Hmm....

Only new about that was, new, to you. Looks well used. Even the air filter cover is put on mis-oriented.
And what’s with that assembly below the air filter? All gouged up?

I am curious why when you asked the dealer to check the hours that you did not go over the excavator yourself before you agreed to have it delivered? Quote; "I went to the shop on a rainy day and asked if they would get the key so we could check the hours" Rainy day or no all the images you show should have been easily seen by you. Not to mention you should have checked the hours at that point yourself rather than allowing anyone else to tell you what the readout was.

I agree that if you were expecting a shiny new machine that what you got would be disappointing. It obviously had sat on a lot for some time and been used to get the 7 hours on it. The tracks should have been cleaned at least before the dealer sent it out to you.

Let me get this right, Would you have accepted that machine as 'new' in that condition? If so I'll provide the contact info and you can buy it.

The dealer didn't go out of his way LOL, he checked local inventory and made a call. It happens every day...

That dealer has 100+ machines on their lot, every one looks new, is clean and likely has virtually no hours.. They represented that KX as new.

A good, honest dealer would have had me come in and look at the machine, discuss its prior use and condition and allow me to make an informed decision. They chose to attempt to hide the facts and ship it to me like that. The sales guy put the key in, turned to me and literally stated the machine had no hours on it.. Hmm....

7 hours is probably 1/1000 of its useful life. I once bought a 2 yr old rental unit with 1500 hrs on it. It had dents and scratches on every panel. I used it for 14 yrs before downsizing with only a starter and battery repair. I think you just let the machine you wanted get away.
I get it you wanted shiny brand new and you were disappointed. But I think I would have made a deal.

I can't disagree about checking the hours myself.. After dealing with that shop for 36 years I had built up some degree of trust when buying new equipment.. We walked outside in the rain, he had the key, he jumped on the machine and turned to me and said there were no hours on it... He got to sit on the wet seat.. LOL

It was delivered ~2 weeks later after sitting incomplete. Rather than being told at the end the machine was finally complete and finished and come look, I received a text saying the machine was on the truck and would be delivered that day.. Zero heads up on completion or delivery.

It’s been sitting outside for a long time for sure.
Nothing is gouged below air cleaner that’s a flexible heat shield / blanket it looks normal just dirty.
They definitely should have cleaned it up and I would want some money knocked off for the fact it’s been outside so long.

That just looks like dirt from sitting outside on the dealers lot for a couple months to me. They could have used a power washer on that but I’d call that machine new. There’s no way they have been digging in the dirt with that machine for 7 hours. My 40 was delivered with 3 hours and so was my 75-3. And they were both actually new. Not demo machines. I guess they let them run 2-3 hours at the factory to check for leaks. It’s your money to do with as you want but i think you’re being a baby. How do you think the machine is going to look the first 10 minutes you actually use it?
