The photo of the trailer is from in front, but it appears to be 3 or more axles. It's to poor a photo to tell
I think from that front boat picture, it is at least three axles. And from a prospective point of view, those are wide flange beams used for the tongue. And guessing maybe 10 inch in height. Again basing on the distance from the tires and the height of the tires. Not sure if boat and trailer are 38,000 pounds, but not 3800 pounds either. Just my thoughts. Jon

4570 added that other picture while I was replying. Yup, closer to 38,000 pounds.

Clumsily is an understatement. The area that create an issue are

From the class C part of the law May drive any single vehicle or combination of vehicles, that does not meet the definition of a vehicle for which a Class A or B driver’s license is required which circles back to the Second paragraph of the Class A requirements which is

Any combination of vehicles not exceeding 70 feet in length with a gross combination weight rating of 26,000 pounds or less so long as the gross combination weight rating of the towed vehicles does not exceed the gross vehicle weight rating of the towing vehicle

So for an example My Ram 1500 has a GVWR of 6.6K I tow a tandem axle utility trailer with a GVWR of 7K So in my case the trailer GVWR exceeded the GVWR of the truck so would fall under their definition of a Class A license. And by the wording wouldn't qualify for the Class C because the GCWR would exceed the 10K

Also from the Class C portion of the law. May tow a combination of vehicles not to exceed 70 feet in length and not to exceed a combined weight rating or a combined weight of more than 10,000 pounds without any additional testing or endorsements.
I'll note here that the except I pulled was from Nevada's DMV "Non-Commercial Class A and B, J Endorsement Study Guide"; hopefully the law itself is more precise, but my interest in the technicalities has faded once I satisfied myself that Nevada is fairly similar to CA in its trailering requirements (ie, I can't pull a 10,001 GVWR trailer without a class A license of some sort, and it's not a stretch to imagine that that trailer - even before seeing the latest pictures of the boat - is heavily enough built to have a much higher GVWR than that).

If he was at the bottom of a long grade and his brakes were gone, with all that open desert beside the road, I have to ask why if he didn't park it is the sage brush rather than run through an intersection and kill 2 people.

Interesting that a bumper pull trailer has such a high GVWR, though.
Pintle setup? I'll bet the specs on the F350's hitch were substantially exceeded as well.

Another link on the web to cross reference: this (post 141) combined 35.5k weight, boat on a 3-axle trailer. Boat is probably smaller than the crash boat. Post 1 in that thread is 36.9k combined, also 3-axle trailer. This puts those boat+trailer combos in the ~28-29k weight range, maybe a 22-23k boat + 5-6k trailer (boat trailers are mostly frame, no decking).

Previous comments here and elsewhere doubted that the F350 "was even a doolie" but if you look at the rims in the first pics shown, it definitely was. Just missing the rear fenders after a bit, along with most of the bed...

Even if the crash boat & trailer were like these linked ones, you're definitely in CDL territory probably in every state, and given that the crash trailer was 5 axles and the boat larger, I can see a 50% bigger boat being near 38k, especially if it's counting the trailer.

Whoever hired or dispatched this guy needs to be looked at too, I'm sure they knew they weren't getting a pro boat trailer moving business. Maybe they were hoping for a total loss for insurance? hahaha.

There’s 5 axels and they’re probably 7,000 pound axels. Although that trailer is probably for moving multiple boats not a custom trailer for that boat so that doesn’t necessarily mean they particular boat is 38,000 pounds.

Class C is for vehicles that don't require a CDL for size but do for Haz or air brakes.

I’d say the boat could easily be a 38 footer. It’s a big one but I wouldn’t venture a guess on the weight. Surge brakes that failed? The picture looks to be during the accident and I’m betting the boat trailer took the left side of the bed off when it broke loose. Tragic accident to say the least.

Yeah, that had no business being behind that truck. Not sure if 38k but way to big for that truck.

It had no business being before that truck even with trailer brakes. With no trailer brakes driving through an intersection was the only likely outcome.

I'm pretty sure the boat stuck with the trailer, but the trailer came off of the truck. My guess is that the truck lost its fender(s) (& bed?) during a collision with another vehicle.
