Maybe it was Photoshoped. I can't imagine someone would actually do that, but I could see where it might be fun to Photoshop it to mess with the kid's mom or something.

If it was real, I'd like to hope that the tree was already broken/cut off 6 ft above the cut. It's not uncommon for tree companies to bring a tree down in pieces.

I also do no think it is photoshopped. I do think he is kneeling. I think that is a climbing helmet.
I did a little google searching. Appears the picture is of "The Community Arborist" posted to his blog 10/18/2009. There's a few comments on the blog properly flaming him.

If youve ever felled a tree you know in the short term that is virtually as safe as no cut at all. Also, motion there is very slow in the far fetched case of a fall starting.
