I bought a NH 575 baler and two kicker wagons on March 27 from Lamb and Websters in Springville, NY (a Case-IH dealer). At the time I bought it they were having their spring auction so they could not bring the baler inside to remove the applicator that was on it (this was the only reason I could not take it). Now, it is April 29 and I still do not have my baler. I got the wagons only because I picked them up at the farmers place who traded them in. Everytime I call my dealer they tell me they are backed up and have not had the time to get it in. I was originally told I would have it by April 2, then April 12 and now it is whenever they get to it. I have been patient and friendly but am not fond of this baler sitting outside when I know they have had plenty of chances to get this thing inside their shop. Now they are using the excuse they are trying to get all the other farmers planters ready. I stopped in one saturday and their shop was full of their trucks for the night. Very few tractors or implements inside being worked on. Should I tell them to keep the baler as I am to the point I will never deal with this dealer again (first time I have dealt with them), or should I just go up there and take my baler and let them come to my place to remove the applicator (and see how long it will take them to find the time). After I bought this baler there I was told about their reputation. It seems they are known to be happy to take your money then after they have it treat you like garbage as they try to get someone elses money.

Also, had I bought this baler later I would not have minded waiting till after the tillage and planting equipment was done but I had bought and paid for this well before they even got any tillage equipment in to work on and they had this baler for over a week before I paid for it when they could have removed the applicator (the previous owner of the baler traded for a new 575 and wants the applicator transfered to the new one). I like the idea of showing up to take it (maybe Mondays are particularly busy for them? /forums/images/graemlins/wink.gif)

when they say you can't have it, tell them it's yours, you paid for it and you are taking it "NOW" & if they want to remove their part "now & within 10 minutes" fine... otherwise, they can come to your place & get their part, OR they can hand you your money back right now...but "I'm leaving here in 10 minutes either WITH the unit, or my cash" & let them decide which is the worse evil.

My wife LOVES to get herself in this kind of situation & rather than HER trying to deal with it.... she sends me in to save her hiney. Calls me her little "bulldog" /forums/images/graemlins/shocked.gif /forums/images/graemlins/grin.gif

I would be a little more on the soft side, I would call them and say I will be there on Friday or X day with 3-4 working days inbetween. Tell them that you are taking your equipment on that day ready or not. If they are not done by that time they can come to your farm and do the work in the field.

It is your machine, not theirs. i would tell them that, then be stern and show up when you said that you would and remove the equipment from their lot.

I agree with Richard. Show up and get it done. It won't matter giving them 3 or 4 days. It will still not be done.

After all this time and knowing their bad reputation do you really trust them to do this job and leave you w/ a properly functioning machine? If the answer is no Id press them for my $. If they say no then Id tell them I wanted the machine now! I wouldnt leave w/o one or the other though. Dont come unannouced...give them a full day...but DO show up. I think taking it w/ their property still attached would open you to some sort of lien (possible court action) if they wanted to be nasty. You might win at court but would the aggravation be worth it? If it was me Id try very hard to convince them that giving me my money was best solution to seeing the back of me.

call the sherrif and report it as either fraud or theft.. They are illegally holding your equipment ( assuming you've paid for it) and will not allow you to have it... Your Bill of sale has an estimated delivery date? If they claim that there is an issue with ther part... Agree to have the part removed and delivered to them within 30 days...

If there is no fine print about time to deliver and such, I would bring it to a head and get my property or money. A call to the police should let you know if you have the right to remove it. Have the police meet you at the dealer if they refuse to release, a report would help. Find out what your rights to the baler are before too much time passes.

My baler got delivered yesterday. Along with it a copy of my complaint I posted on the Successful Farming board was stapled inside my operators manual. So did I get my baler because I complained on line and they saw it /forums/images/graemlins/grin.gif? Or did I get it because they just happened to find the time /forums/images/graemlins/smirk.gif? I love technology. Take care guys.
