There is usually a dip stick or a sight glass on every transmission (assuming that the fluid volume is also used for the hydraulics)

I can see foaming and frothing problems for engines, or high speed automotive transmissions / automatic transmission.

But for an eight gallon tractor system to be high by even a gallon, What harm ? I have found none. I'm sure there is an available space issue that varies from make to make. There may be considerations specific to hydrostatic drives also. (My little garden tractor with a Eaton drive could care less, just don't let the level get low! ;-)

Theoretical alarmists?.. comment from experience please.

Well they usually leave a small amount of space in the reservoir for expansion of the fluid as when you operate cylinders and such the volume in the tank will go up and down. Only thing that will happen if you over fill the tank is oil will spill out the breather making a big mess.
