How about conveying to your mortgage co that you cannot afford a $4K annual expense, & that there's a decent chance they'd have to foreclose on your home, taking possession of a property nobody else will want to buy.

This whole issue reminds me of the Health Care cr@p.

If what you say is correct, find a lawyer that dose this kind of work not just any lawyer and sue, sue, sue. Go for their lungs, put them out on the street.
What ever documents you have save, use e-mail and save everything to one file on this one subject.

That's good advice, as long as the attorney you hire to handle this case will throw in the personal bankruptcy for free.

You could benefit from having your property checked by a surveyor. The Arial surveys can be off by several feet in places. I work for a land development contractor and before we start any job we have our surveyors check the actual topo elevations against the plans we have. Most of the time they check out but they have been off by several feet. It can make for a lot more haul off or haul in than we originally estimated. Trees and heavy growth can give false readings.

Two thoughts...

Something similar happened in the city where I live... it affected several hundred homeowners that organized and there was not a local, county, state or federal official not aware of how this voting district felt and how organized it was.

The end result was the lines were reduced by 80%... mostly because officials just wanted the problem to go away and could be justified after the firm was told to make a site visit to each property.

A second thought... is there anyway for you to refi privately?

I admire the effort and research you chronicled in finding and developing your property...

I'm going though something on a much smaller scale right now... the fire district assessments are going through the roof and the fire inspectors have almost absolute power... the problem is they really have NO IDEA as to property lines and ownership... it has taken much time for me to deal with...

I received threatening letters that my property was subject to abatement and liens for failing to correct... finally, my councilman set-up a meeting with the deputy fire chief... he was a little annoyed... the meeting went like this:

Just what don't you understand... the property has been declared a fire hazard and the determination is final... I asked him to point out the area from the bluff and he did so to humor me... he then said I had 7 days to clear or the city will do it... do I understand?

I said I agree 100%, the area is a fire hazard to me and the neighborhood... he said glad we are on the same page...

I then asked how soon will the city complete the work... he cut me off and said he was wasting his time... then came the bombshell I had been saying all along... THE ACERAGE IN QUESTION BELONGS TO THE CITY SCHOOL DISCTRICT AND HAS FOR OVER 50 YEARS!!!

Sorry for the rant Alan... I can empathize with you family's situation.

PS... Several weeks have passed and the city has done nothing now that the ball is in their court.

PPS... Is there anyway to use the findings to lower your taxes?

i think Fema redraws the maps to get more money into their coffers so they can pay for the next disaster that happens. (after all we wouldn't need disaster relief if people would just buy insurance)

I say get insurance on your property and if you flood your covered if you don't have insurance don't expect the gov. to bail you out. Then we can disban Fema.

I would "like" to say that this whole topic is yet another reason not to borrow money, including not borrowing for a house. However, even if most of us did that, the govt would still do stupid stuff like this, i.e. trying to get $ from some of the population to fund various things.

OK, I have cooled down some....

I have had insurance for $355 a year since 8/07 (house completed 6/17). This is the preferred rate for zone X. It went two years with no comment, then I got a letter saying the carrier had changed but coverage was the same. Then the date of the renewal got close last year and I had not heard anything from the insurance co. I called and they said I needed to "recertify" the information. I sent them a copy of my survey showing the house NOT in the flood zone and they renewed the policy.

I asked what the rate would be if the house was in zone A and the answer was "more than 4 thousand". I checked rates today on the internet and it appeared for house and contents the rate would be $2700, but only $1700 for house without contents. Thats for $250K maximum coverage, which would be just about what the house could be rebuilt for right now (but probably not 10 years from now).

I fired off a letter to my congressman Ralph Hall, whom I have supported my entire voting life. I was much more civil than the tone I have shown on my rant in this thread. I doubt I will hear anything other than a thank you for the letter and that they will look into FEMA and blah blah blah.

I don't blame the lender at all. What I don't understand is why should I have to pay to do the job FEMA should have done? If I built where I did because of the incorrect maps they provided why do I now have to pay for their error?

I did more research and it does appear that perhaps I could be grandfathered on my rates as I have had uninterrupted coverage since 8/2/07 and the map change was effective 9/29/10. I just don't have confidence FEMA is going to do the right thing based on the conversations I have had with them so far.

The house was placed based on two things: First, it was the obvious high spot although near the creek (which is why I got flood ins although I can't see it ever getting that high). Second, the surveyor drew the FEMA lines on my survey based on the measurements from their maps. No elevations were done because there are no points of reference. They would have to survey from my place to miles away to figure out how much higher it actually is to what they call the flood zone. Not only did we build outside that zone, but we put about 36" of fill and built on that. The problem is the cost of the engineering required to accompany the form to be submitted to FEMA to get them to change the map on my property.

You can bet that I will in fact use this information at my next property tax hearing. So what if I get the value way down, then when I'm old and need to sell out I will have a real hard time selling a flood zone property that the county has acknowledged is not worth much.

Actually, you remained much calmer in this thread than I think I could've.

You can bet that I will in fact use this information at my next property tax hearing. So what if I get the value way down, then when I'm old and need to sell out I will have a real hard time selling a flood zone property that the county has acknowledged is not worth much.

No matter how old you are at the time, you will need to be a good salesman. I will be in the same boat*. Maybe we should get together & write a how-to book on it ahead of time.

* Hopefully not literally. Although then maybe I'd have "lake front property" instead of just "swamp" & "flood zone"

One more thought... it doesn't hurt to mention you are a Veteran and I believe you are.

Right now, stories in the news about plights of Veterans have a more sympathetic appeal in my area...
