Looking for info on protected species of underbrush and trees near wetland areas. Have a customer wanting a small area mulched/underbrush cut and the property backs up to a designated wetland area...Dont want to get caught w/ my pants down and cut the wrong stuff!!! Cypress is surely one type but I think there are fern species,etc..Also other customers not near wetlands but im sure there are some types of vegetation not permitted to be destroyed...

what florida dept could i contact? Any ideas? Surely someone has run into this...?

i'm not from your area but i would think a call to the local ag extension or forestry dept could help out some. at least the ag extension may be able to point you in the right direction.

Local county gov that oversees retention ponds. Retention ponds are considered wetlands if it holds water. Here it's cat tales. But our guys here will let use mulch them also because they grow back so quickly.

Pitcher plants, for sure. They are on the endangered species list. If the area has been delineated by a wetland specialist, STAY OUT. The Corps of Engineers hs interpreted mulching to be synonomous with dredge and fill in Louisiana. If you are unsure I would contact the local code enforcement officer and ask how the rules are enforced.

In Wisconsin, I can place 2-3 inches of mulch anywhere, even next to my wetlands (swamp??). I took the time to read the DNR regs (Department Natural Resources). Anymore than 3 inches and I have "broken" the law. Anything less than 3 inches and I within the law.

The neat thing about the DNR regs is they "fail" to say how often I can apply 2-3 inches of mulch. Every day? Every month? every 2 months, every year?

The area you described sounds like Army Corp of Engineers I think 404 wetlands here in NC you can mow/mulch it but you cannot disturb the soil. That means no tracks or shaving down to the soil.
