I just read the posts regarding getting tax-free diesel.

Back in the late 50's & early 60's (some of my earliest memories) we had gasoline delivered to a tank on the farm and paid a lower price than the pump price. I'm think that that was because there was no federal tax. I was only 10, so didn't understand what the adults were doing.

So--I am wondering if gasoline for farm use can be purchased in any way to not pay that tax. Might be a moot point in our area; I've asked fuel dealers & they have no idea.

Even though this part of Colorado used to be an agricultural area, not many folks here in our now urbanized area have seen a tractor other than on reruns of Green Acres!

Anyone know anything about this?

Thanks!

Unlike diesel, you can file a form 4136 with your taxes and get a refund (credit) on the gasoline tax. If you are not farming, there are other means to claim the credit if the gas was used in a nontaxable manner.

Ahhh, form 4136. Thanks. I'll take a look at that at tax time.

Catsco:

Whatever you do, don't put off road diesel (dyed) in an on road vehicle. The fine is very stiff. It's around $5,000 for the first offense. That would buy a lot of on-road diesel. Not as much as last week, but still an appreciable amount!!

It's easy to catch a perpetrator too. All any law enforcement official has to do is stick a clear piece of tubing in your filler neck, put his finger over the end and withdraw the tube. If it's red, you are in the "red"

It's worse than that. If the tank prior to the one they are checking was dyed, they can still detect it and will hammer you accordingly.

IIRC, the way this law is written, the authorities need no probably cause to check you, either. Simply owning a diesel vehicle makes you a suspect and they can check you any time they want.

I know a guy that adds used motor oil to his tank to defeat the dye. More crap than I'd want to go through.. and risk... just to save some money. But he does it.

In Virginia we file a form with the State Transportation Board listing all gas and diesel purchases accompanied by receipts and we get a check in the mail for the taxes that we paid.

He pours dirty oil into his fuel tank? Man, that's desperate. /forums/images/graemlins/crazy.gif The cost of damaging just one injector on my truck would pay the tax on a lot of diesel.

He's in for a big disappointment. The used motor oil will probably go a long way to plugging up a fuel filter quicker than normal, but it won't do squat for getting rid of the dye.

That's a good example of natural selection at work. /forums/images/graemlins/crazy.gif. plus will keep the mechanics employed in his area.. not to mention the DOT as they fine him big time for having dye in his tank...
