I've been in the forum for a couple years and I've noticed some things over time. Had this dealer been any other color than orange or green and this thread would be a dealer trash fest by the same posters who are absolving the dealer now. You would even have them on your side, pushing forward to take legal action or something alike.

For a used tractor, no matter which color sold it, the OP needs to look at the application of the Uniform Commercial Code implied warranty for each state involved. Part of which states,
“when the buyer before entering into the contract has examined the goods or the sample or model as fully as he desired or has refused to examine the goods there is no implied warranty with regard to defects which an examination ought in the circumstances to have revealed to him”

We will just have to wait and see how the dealer reacts.

The thing that makes the hour meter important to me is the claim of a number of hours on the equipment. When I talked to the dealer on the phone, I didn't specifically ask whether the meter was working. I believe it was implied by making the claim of hours on the mower.
While a picture may be worth a thousand words, what real claim has been made to accuracy? Quite a few of the ads I have looked at say something like; hour meter shows or hour meter displays. Other ads say accurate/verified. The devil is always in the details, right?

It’s pretty obvious why the hour meter indication is important. Your previous post indicated you HAD seen ads that noted the hour meter was NOT working so you would know that is a possibility.

The common law doctrine of Caveat Emptor is still a good practice.

oh, now I know what you're referring to. Random adds that people have admitted that the meter isn't working. That being the case, they wouldn't make a claim of hours on the equipment.

Here's an example of hour meter picture and claim in text of 1095 hours. You're suggesting I should ask the seller if the meter works? I don't like to assume but there are times when things are implied that you have to take for granted. Does it come with tires or are they just for picture purposes lol?

Yes, I would ask that question. As a perfect example; he mentions blades, spark plugs, ect. I would ask about belt and spindles, as those are not directly mentioned. If it shows up with a very worn (but not missing/broken) belt, he should be covered. It works, and he made no claim those where in good shape.

Also, Ebay, was a definition of used vs parts/repair, and they enforce a return policy if not accurate. Fully Operation... that doesn't mean it doesn't sound like a helicopter from bad bearings, and the hour meter has no affect on 'full operation'. If I was buying this mower; 100%, I would want to ask questions.
