It isn't that simple. If all I had was one Ford/New Holland tractor then it would be easy to stop dealing with them. However, this dealer is within 2 miles of my farms. The next NH dealer is almost an hour away. The Deere, Case-IH and MF dealers are all a half hour away. If my NH baler, NH rake or Gehl discbine break down this NH dealer is the place I need to go to. I try to have two tractors that can run any implement I have so that isn't as big an issue as I can plug another tractor onto an implement of the tractor breaks down. But location is a huge issue for my farm operation. I have had my baler break down and I drove the tractor and baler to the shop and had the mechanic fix it for me on the spot and I was back in the field in an hours time. I would just be getting to the other NH dealer without the baler. So I do need to try and keep things friendly.

Robert, its just simply not right and they need to be told that. Have you asked for a professional opinion from an attorney?

I am going to talk to my dealer again before I talk to an attorney but I have already thought about it. As soon as you mention lawyer in a conversation you usually have two things that happen. You either get told where to go or you get results. I would like to resolve this without having to pay lawyers or cause hard feelings. The situation isn't very good but I need to try and keep things civil for my own needs in the future.

If I cause hard feelings now then whats to say I don't get told where to go if my baler is broke down and I have 20 acres of hay to pick up:( It is really a no win situation:(

Plus since I can not pay a $13k repair bill I am being charged interest. Almost $200 a month:(

I think next time, you need to go to one of that dealers at 1 hours drive to do these major repairs, and stay friends with the guy next door ;)

seriously, not all dealers have the knowledge and experience to do these repairs. There is a Zetor dealer 5 km away from us, but i never ever have him do repairs or buy parts, i go to a big dealer about 20 km away, these guys sell loads of tractors, and also buy lots of tractors with major defects from all over the country, even from England and France, which they repair during the winter months and sell with good profit.

When i had questions about how to open my 3011 i called them, they explained it in a few words and that was all i needed. I said that it took me a day or 4 to get this far, including making my own special tools and pullers. He said that the second one would take half the time, and his personal record was 2 days to overhaul a transmission that had run dry, including taking the tranny from the tractor.
This was a job for another dealer elsewhere in the country, who didnt even know how to begin this job. they went there 2 days and fixed it.

I do all the repairs by myself, but if i ever had to outsource a repair, i do know that there is a major difference between dealers that sell and service, and dealers that know them inside out and can overhaul (in half to 1/3 the time of other dealers.)

If they keep your tractor and throw away the bill in return, your loss would still be a LOT more than the difference between the value of 7710 with defects, minus the price of the 7710 with NO defects:
conclusion: they put a lot of money into a tractor that wasnt worth it, and that you wont earn back when you sell it.

For Dutch jurisdiction, a deal in spoken word is as strong as a written deal. Problem is, if there is no one who can testify the agreement, its your word against his.

My father was with me as we stopped in after work to see what they found. He can verify what was said but it would be better if it was someone other then family. Now how do I go about filing in the Dutch courts:)

Actually, If I was in your shoes, I wouldn't sell it. Instead, I'd try to negotiate a delayed payment if the guy won't reconsider his tactics. If he still has the tractor, let it sit there. For 1/2 the money you can buy a 4020 to replace it.

What I'd really like to know is whether this forum is courageous enough to raise the cash to get this debt relieved. I'd send the dealer $10. If only 499 members sent in the same amount, then you could give him your agreed upon $5K, he would get $10k, (and might settle the score with this amount) and the local papers (Buffalo News) would have a field day with this story. Just tell us who and where the dealer is. I grew up near Silver Creek / Irving and wouldn't mind a trip back there to watch the trains pass at Sunset Bay.

Anybody would be welcome to mail the dealer a check or deliver their penny collection.

I appreciate the offer but must decline any help. I managed to get myself in this situation and will eventually get things figured out. I hope to avoid any legal issues as paying lawyers to negotiate for me always bothered me. I am going to talk to them again this week and hopefully will get things hammered out.

My daughter loves it when we go to dinner at Toms restaurant in Irving. She can usually see the trains go by and has a strange fasination with trains for some reason.

The 4020 is a nice older tractor but isn't as refined a tractor as I need. Plus it doesn't have a good cab. Depending on who is helping I need more refined, easy to operate tractors. Plus with my new condition I need a tractor that is comfortable and easy on my back. I would like to find a decent used New Holland TS series with FWA and cab if I had to replace this tractor or if I had the money a TD95D or the JX version if things don't go well with the local dealer. On the bright side if I need to I can always use my friends 7700 if I have no other option but I would rather keep my 7710 if possible. It is a great hay tractor and will do the tillage work I need it to.

If I get mad enough I have no problems owning a Deere tractor, I am just do not know the different models as well as I do the Ford/NH and Case-IH tractors. I have a couple Deere machines already so what will a couple more hurt:)

Wow! I hate to hear stories like this. Truthfully the only way you can get your money out of this is by working it out. After all the tractor should be ready to go for a long time now. It sounds like you are a good customer of his, hopefully he will negotiate on this to keep a regular customer.
