The Delhi High Court has rejected the Escorts hospital's plea against the eviction notice it had been served for not providing treatment to the poor as part of the agreement for lease of public land.

While dismissing the application of the Escorts Heart Institute and Research Centre (EHIRC), a division bench headed by Chief Justice MK Sarma on Monday said Delhi Development Authority (DDA), the land allotting authority, was justified in issuing the eviction notice as the hospital management was not adhering to the clauses in the agreement.

DDA's estate officer had issued a show-cause notice to the hospital for eviction, saying it had violated the terms and conditions of the lease deed that specified 20 percent free treatment for the poor.

In its application, the hospital contended that instead of conducting proceedings under the Public Premises Act ('eviction and unauthorised occupants'), the DDA should have filed a civil suit for taking back the possession of the land.

Counsel Sanjeev Puri appearing for the Escorts, now run by Fortis Healthcare Ltd promoted by the Ranbaxy group, argued that the land was never given on lease by DDA to the hospital and the estate officer had no right to issue the eviction notice.

DDA's counsel Ajay Verma argued that Fortis, a commercial hospital chain, had purchased EHIRC last year and the group was not entitled to avail of the government land, which was allotted at a concessionary rate.

On October 6, 2005, the DDA had asked EHIRC to evict from the 6.9-acre land as hospital authorities allegedly were not providing free beds to a required number of poor patients and transferred the hospital to Fortis for Rs 6.50 billion.

The land was allotted at a concessional rate to the Escorts Group led by late HP Nanda for establishing a charitable hospital and the hospital authorities were not supposed to transfer the ownership of the land to a third party.

EHIRC was established as a society in 1981 under the Societies Registration Act, 1860.

Between April 8, 1982 and June 14, 1996, DDA under the urban development ministry had allotted the land to EHIRC for setting up the multi-speciality high-tech hospital.

However, Escorts chief Rajan Nanda established another stock company at Chandigarh and amalgamated EHIRC with it on April 1, 2000. The amalgamated society was registered as a limited company on June 30, 2000 before it was sold to Fortis.

The main petition is pending adjudication before a single bench in the Delhi High Court.

The court had directed Nanda to maintain status quo and not to transfer its ownership till the matter was decided.

"There is prima facie evidence that some alleged violation has been perpetuated in the deal," the judge had earlier said in an order.

Nanda's estranged brother Anil Nanda in a petition alleged that the hospital was being sold violating all rules and regulations as it was established as a charitable institute.

"Late HP Nanda, the founder of Escorts Group of Companies, had conceived the idea of setting up a charitable institute of world fame to help the weaker sections of society and to create a medical infrastructure for the citizens of India. It is with this vision that EHIRC-Delhi was formed as a charitable society," said the petition

DLF Ltd <DLF.BO>, India's largest listed real estate firm, is in talks to buy land from tractor maker Escorts Ltd <ESCO.BO> in a deal that could be valued at more than 15 billion rupees ($380 million), a local daily, citing unnamed sources.

The land is spread over more than 200 acres (81 hectares) and is close to the capital Delhi, the paper said on Thursday.

A DLF spokesman said the company would not comment on market speculation. An Escorts spokeswoman gave a similar response to the paper.

NEW DELHI: The Income Tax department on Thursday conducted a "search and survey" operation of the Escorts Ltd offices and plants for alleged I-T evasions and illegal appropriation of assets running into several crores.

During the surveys, the I-T sleuths also checked the book of accounts, cash, stock and other valuables of Escorts and its healthcare arm -- Escorts Hospitals. "We will now prepare our report based on the findings of this survey," an I-T department official told The Times of India. The I-T sleuths have also recorded statements of concerned persons from the organisation, he added.

An Escorts Ltd spokesperson confirmed the I-T survey saying, "It was not a raid but a survey that the department conducts for ascertaining facts. Our income tax and finance departments have cooperated with I-T officials and we have presented all the documents that they wished to see. We do not have anything to hide."

The Escorts group was primarily alleged with "illegally" transferring the charitable property of its hospitals in their personal names, thus cheating the government of crores of rupees. The hospitals were constructed 18 years back after being registered as a charitable institution. During these years, the hospital authorities had been claiming income tax exemptions as a charitable institute, besides other benefits.

However, three years back, the property acquired by the charitable institute was transferred to some individuals as one of the owners of the company acquired 80 per cent of shares of these hospitals, 10 per cent went to a leading doctor and another 10 per cent to some more individuals.

The I-T surveys also sought to ascertain allegations of massive income tax evasions by the Escorts group, particularly in view of the recent large scale sell-offs it had conducted. The Escorts group, which had recently sold off its holding in the motorcycle venture with Yamaha, is also planning to dilute around 26 per cent of its holding the healthcare venture.

It also sought to ascertain the losses that Escorts Ltd had reported in the first quarter this fiscal despite these sell-offs. Escorts had last month announced that it has posted a net loss of Rs 16 crore for the first quarter ended June 30, 2003 even as its total income had increased from Rs 168.83 crore in Q1 last year to Rs 205.8 crore in Q1 this fiscal.

The surveys were conducted under sections 131 and 133A of the Income Tax Act and all the records from the hospital had been seized.

Guy says he found them all over NC/SC just setting in fields behind behind tractor dealerships.Ask the dealerships if they knew who owned the tractors and they were told some guy in India. But he ain't coming back for them just gettem if you want'em.

Wouldn't that be a hoot? Some one steals a tractor from your inventory and you have to pay $1000.00 deductible. Come to think of it that's about 1/4 of the discounts we are offering so that wouldn't be a bad deal. Anybody know how to get in touch with "Light Fingers Louie"?

"steal your inventory" Textron says it's their inventory surely they have it insured in case Louie gets a new truck and trailer!!!!-----nother man said he can get all the Farmtrac tractor parts you need just give him the model-----engines, trans sheet metal etc. The woods are full of them in Tenn. No checks just cash he said!!!!!

When it's time to collect interest it is Textron's inventory --when it's time to put a new seat and coat of polish on it's your inventory. When it's time to discount it's your inventory. No Textron doesn't insure the tractors and equipment---they require the dealer to do that!

What a joke, -- a bad one, at that?!

Basically, you're saying that retailers take all the risk, responsibility and exert all the sweat, but TFC wants to scoop the gravy off the top ... then turn around and gouge dealers for curtailments and interest they originally waived to hornswaggle dealers during their tractor-loading conspiracy last fall/winter?!

If so, it's hard to imagine how dealers would ever trust them again in *any* form of negotiations. Wouldn't make sense.

Just one guy's opinion.

Question for the "wise" ones: When a ship is sinking and taking on water-at what point do you start bailing the water out???? This Farmtrac mess has been going on for 7 months now. Less than 50 tractors have been sold across the USA since Jan. Contrary to belief, dealers do not set the price for the tractors sitting on their lots. The floorplan company Tex*** sets the price. With a very minimal amount of tractors sold for the year, don't you think it would be time to start DISCOUNTING the units to get them moving before the tires go flat and the paint fades away?? There are alot of customers out there waiting to buy Farmtracs (and rightly they should because they are good running tractors) BUT they are not going to buy them at last years prices! They want discounts to reflect the age of the tractors and/or condition that it is in. DISCOUNTS=SALES!!! I think we need to get some discounts and that will get rid of some of the water in the ssinking ship!

DISCOUNTS?????!!!!!-----How 'bout they just redo the invoices for the amount they paid ESCORTS at the factory and take out all that false profit that they baked into those invoices when they "Sold" the paper to the dealers. (First reverse all that incentive pay to those employees that got bonuses for selling all that false paper)We all know that those were not sells but kites. What do they add to each invoice 20-30% that's alot of money.DISCOUNTS!!!!! I quess in their math they would have you believe that 2+2=6 and with their "Help" it now equals 4. So if they want to do a match discount :mad: they better be sure it is a true match not they lose paper profits and you lose the kitchen sink. There is a difference!!!!! :( :( :confused:

This Farmtrac mess has been going on for 7 months now. Less than 50 tractors have been sold across the USA since Jan.
The Benjamins are not flowing... retailers report that on many a day, neither are the Washingtons.

- If dealers sell tractors quick and eat the loss, Darth Raymond's crew gets it "up front."
- If dealers are unable (or unwilling) to eat the loss and don't sell units, TFC will push to collect interest and curtailments.

You need to contact SESS, She needs consoling big time. The Federal trade commission said FARMTRAC, Escorts and the Indians did nothing wrong! Try to convince the "Not Even Zero" customers that they did nothing Wrong!! Senator Christopher "KIT" Bond's office has apparently washed their hands of the deal. Guess I'll have to find where the Democrat button on the voting machine is. I will post the contact information for Senator Christopher "Kit" Bond on this site as soon as I can. There may be a lot of "Not Even Zero" customers wanting to make a campaign contribution to Senator Christopher "Kit" Bond's next election!

I received notice from Senator Bond's office in Missouri with a response from the Federal Trade Commission (FTC) today that the FTC cannot pursue a case for wrong doing, because no laws were broken against my personal dealership. I could not bring complaints of wrong doing to the FTC for all the LESS THAN ZERO customers because it did not happen to me specifically.

Attention all Less Than Zero customers: If you want any resolution on your behalf against Farmtrac NA, then YOU must file a complaint with the Federal Trade Commission. Again, here is the website https://www.ftccomplaintassistant.gov/ and you will click on the icon that says "FTC complaint assistant". It takes less than 5 minutes to file the complaint against Farmtrac. I do not have the specific number of customers that purchased the LTZ plan, but to equal $2.9 million it has to be a bunch!!! Please take the time and file your complaint. Wrong is wrong is wrong!!! We have to stop this from happening to other people down the road. Feel free to send me a PM with any questions.
