I see that you are in Kentucky just like me. The law here in Kentucky, if it is still on the books is this. Who is to pay for a new line fence between two farms. If both farms on each side of the fence has livestock in them. Then the expense of the fense will be split half and half. If one farm has livestock on it, and the other does not, the other farm doesn't have to pay for half of the fence. Now, this law might have been changed since several years ago. My dad had a farm before he died, and he had livestock on it, and the other farm had livestock also. Dad wanted to put up a new fence, and the other farm didn't want to pay their half. My dad checked the law out on this, and was told to go ahead and put the fence up, and if the other farm would not pay their half, that by law part of the other farm would be sold to pay for their half of the fence. I know other states might have a different law than this, but this is the law on line fences in Kentucky, if it hasn't change in several years.

I'm not in KY but talking to some folks last year while quail hunting in your state that is what I remember hearing.

If it were me I would offer to help at least. yo said something about fenceposts you had that you had now use for, offer them to him. Being he need sthe fence and you're willing to help and on friendly terms I'd say he'd be happy with that and yor help. I would be anyway.

Oe thing remember, in IL you aren't obligated to pay for half of that fence if you don't run livestock against it, but if you later do he can come back with a bill for half of that fence and then you are obligated.

I agree with others who have posted, it's not a requirement to pay half however, it may be cheaper in the long run to chip in some $ and labor to gain a good neighbor. That may be most valuable for the long haul. Just ask anyone who has been at odds with a close neighbor.....
On another thought, I have always heard ( may or may not be local ordinance) that if you are putting up a fence between you and your neighbor, that the "good" side must face the neighbor. Otherwise you are detracting from the asthetic value of his home. If you want the good side in, then you need to build both sides of the fence. Either way, GOOD LUCK!!

The thing that concerns me the most on a "NEW" fence, is keeping it on the boundry. Fences are famous for wondering across boundry lines. On some really long runs, a fence has been know to bow into the adjoining property severel feet.

After the fence line is cleared, I'd get a surveyor out there and have them mark the fence line. It's the only way to avoid future issues, especially if you, your neighbor or either of your heirs ever decide to sell all or part of your land.

That's what I'd spend my money of first.

I met with him and we walked the fence line.He only wants to remove enough trees to get strands of barb and metal posts in.All the trees are on me so I told him to go ahead.I went ahead and priced out woven and am thinking about trying to upgrade his intentions.His prob is we dont share as much fence line as I thought,his stops about 3/4 of the way down of mine and I'm the only chance he has on any help.This hits at a bad time for me as I have just a couple of weeks to finish my barn.If he can wait I'll help by drilling postholes and help stretch,but I'm gonna want to use woven on my half.Not a big fan of barb.
Anyways it was explained to me the way cabinholler said except that here the county pays it and adds the cost to the property tax in payments over 10 years,thats if both sides run livestock.That could really hurt a little farmer if he joins a big farm.

If the need arose to fence the property I think a comfortable tractor width between the fence and the property line might be a prudent idea. That way you could use your rotary cutter to keep the fence-line clear. And you could also use the assistance of the tractor or other means to keep trees and bushes beat back and off of the fence-line at a later time.

Ask him if he would be willing to help you finish your barn. You get that entire Amsih crew out there and it'll be done in no time flat. You'll both be even happier with the whole arrangement, he'll help you with your barn and you'll help him with his/your fence and everything gets done quicker.

What if one guy has horses and the other cows? Both require different type of fencing for each animal.

Where I live, I put up my own fence and kept one side 25' off of my property line and 10' off of the line on another part. My idea was the same; I could maintain both sides. I ended up planting bushes on the outside of my fence and pine trees on my side and now have a visual boundary as well as the fence. I'd like to fence my other property, but it will be nearly 3 1/2 miles of fencing. I don't know about that one. /forums/images/graemlins/crazy.gif
