--------------------Too bad, My property has NO easements at all (not even for the road, none for utilities and nothing for 'communications' equipment (cable company wires). They have road access based on what they been maintaining for 100 years (12' wide prescriptive easement).-----------------
I wouldn't get over confident and brag too load. Someday some bureaucrat may come knocking on your door with an eminent domain document in their hand. :eek:

Which, by-the-way, I totally disagree with privet property being taken away with such eminent domain laws. Such laws are abused by big money stuffed in political pockets. But that's a whole new topic.

That's where these 'agreements' and other amateur written 'contracts' aren't fair. Consider, two households:

1. Single person, one or two passenger cars, travels the road only a few days a month, maybe a dozen trips in/out total. Maybe a few UPS or FedEx deliveries a year

2. Family of five, all driving age, all have vehicles, some larger pickups. They travel the road several times a day, some vehicles making multiple trips. They also get frequent deliveries.

Why should these two households pay the same rate?

Life isn't fair. Consider same 2 households, identical income.
(1) Married couple, renter, no kids.
(2) Married couple, homeowner, 4 kids under 18.

Who pays more income tax?
Why should those with no kids, no mortgage interest or property taxes subsidize those who do?

For a paved road, loading from passenger vehicles is negligible. Weather and trucks are primary cause of deteriorating conditions

Not a big proponent of cameras but here they could be useful. Those caught driving through pot holes should face heavy surcharges.

That whole HOA plan just seems like a barrel full of laughs. My lady friend manages condos, so I hear a lot of good stuff.

Like (mostly) seniors that drop their keys down the elevator shaft. $500-1000 service call later, they get their keys back that everyone pays for. How is THAT fair? But, that's the whole point, shared living space and expenses.

Why would lost keys be a community expense? Dropped keys should not harm the elevator

When everyones money is ever put into a pot, you must forget any expectation of fairness. Some will come out ahead and others will not.

My neighborhood is a mix of Road Assoc, and neighborhood agreement.

The two main roads are in our Road Assoc. The only thing the Road Assoc does is maintain the road; we DID NOT want a HOA.

The side roads in our neighborhood(mine included) are not part of the Road Assoc; it is up to the neighbors to maintain. Have been fortunate, the 7 neighbors on my road have all been good about chipping in to maintain the chip seal road.

We had our road, and two main roads in the Assoc resurface with Petromat and chip/seal. Works great, holds the base really well.

The MAIN thing the road companies have told us, is to maintain drainage. They see more damage from bad or poorly maintained drainage...
