You can avoid including most vehicles and many accounts in any probate proceedings in Texas by filing a few simple forms with the proper agencies. Things like vehicle titles a very simple. We got all the forms from our Wells Fargo Advisors representative. Easy to do but ya gotta do it.
Of course, these things all vary (sometimes considerably) from one state to another. For example, my state does not issue titles for vehicles over a certain age.

My sister was the executor of my parent's estate when they passed in rapid succession a few years ago. I recall a slight glitch when my father's car was titled in his name only (he passed first). I believe in my state providing the dmv with a death certificate and documents of administration and/or power of attorney were adequate to transfer the title to my mother. When she passed, the executor was able to transfer the title to whomever.

The article posted about the ex boyfriend was interesting. If she was co owner on the title with financing through the ex boyfriend, I would think the finance company would pressure him into fixing the title. They certainly wouldn't like a co owner with no legal obligation to repay the loan.

When my father pass I went to town hall with death certificate and proof I was the executive of his will,sign couple papers and done...but that's New Hampshire 20 years ago.

When my FIL passed, my wife inherited his Harley. Then we found out he never registered it in his name. The title was the previous owners. Since we don't ride, we decided to sell the bike. It was a nightmare to resolve the situation. We had to do a lot of paperwork and get a Bonded Title in my wife's name before we could sell. A great guy wanted the bike and was very patient for several months while the process took place.

Got to ask, what is the age? I'm also assuming that NH does not issue a drivers license over a certain age?

1 - You were the executor of his will.
2 - You had the death certificate
3 - No probate or lawyer involved afterwards?

My wife and I, both 40 and only ever married to each other the last 15 years, have everything in both of our names except the title for my horse trailer and the loan that was on my tractor.
The only reason on the horse trailer is when I bought and went to title it she was still out of town on a vacation with her mother and the tractor loan she just didn't feel like going to the dealer to sign paperwork with me. Considering tractors have no title its still half hers anyway.

At the end of the day, nothing is "black and white" when it comes to legality given the siutiaton was my point in posting that example.

Considering tractors have no title its still half hers anyway.
Interesting read....


Wives weren't always treated as such today vs the past when it came to inheritance. What we figure is common sense today wasn't the same common sense even 100 years ago. Reality is our law as a nation "at the time" wouldn't reconize the illigimate children of one of our own founding fathers of our country.

I Googled it, and this is what came up:

New Hampshire does not issue titles for vehicles that have a model year of 1999 or older, except for heavy trucks with three (3) axles or more, or truck tractors whose gross vehicle weight exceeds 18,000 pounds which must always be titled regardless of age.

As far as licenses go, as far as I know there is no upper limit...my mother is 93 and she still drives.
