Time is always your enemy when it comes to stuff like this. A girl parking next to me at my apartment damaged my freshly painted car, while she was parking. Perfect match for paint on her car. She confessed and agreed to pay for damage. Then nothing. Then denial, that she ever did it.

Somehow you have to get something in writing, right away, and document everything. My incident was many years ago. Cell pictures and an audio recording of her confessing, would be good.

BUT, then if it goes to court, ordering a party to pay and actually having them pay are two different matters again.

Two comments.

First, what some others have said. Since the course is giving you the run around go through your insurance. State Farm has told me something like this does not affect my rates. It will take awhile but they will get the whole thing covered and send you your deductible. At least State Farm does.

Second, some attorneys are slime balls and deliberately delay figuring if they delay long enough they won’t have to pay at all. In that case, definitely file with your insurance. He won’t be able to ignore as they have attorneys who will go after the course.

A third thing, (I know I said two comments). After you file with your company, the other insurance company, maybe even the course or lawyer, may contact you. Be civil but They are trying to avoid paying or cutting what they do pay. My response was always talk to my insurance and I would not get dragged into saying anything more.

Wow a lot of responses in 24 hours first of all thanks to all. I tried one last time to contact the lawyer but he was just leaving for court the secretary said she would have him call. I believe her as I remember her and she me from high school too many years ago. But guess what no call so I left a message with my insurance company and will go whatever route they recommend but I hope the coarse has to pay eventually because of the design. That ball could have come through the drivers window as that was the side it hit on if I were going a bit slower.

just imagine someone on a Bicycle or Motorcycle, they may get killed by that!.. the Golf Course has a responsibility to prevent balls from causing injuries as I have posted the link to a Lawyers opinion on this..

Pay the deductible and get your new truck fixed. Your insurance company should subjugate the claim to the golf course's insurance company for payment. Once paid, they should reimburse you. At least that is the way it is supposed to work.

Many of those no-paint "Dent" specialists do an incredible job. I would prefer that to a body shop coat of paint over the new oem paint anyway. Could be cheaper too and more agreeable for the course to pay.

But that's a Deer, NOT a stupid Golfer. I agree with Moss, HE should pay. At the very least, he should pay your deductable. That would be letting him off very easy.

I came out of the lumber yard a few months back and a guy and his little son were inspecting the side of my truck. The boy had thrown open the door and put a pretty good ding in the new truck. He gave me his number and asked to get an estimate. The body shop wanted $1,500! I went to a paint less dent removal guy and he was not sure he could fix it. Told him it did not have to perfect I just did not want to see an obvious dent every time I walked up to the truck. He got it and the only tattle tale is a small nick in the paint. The guy that was responsible wanted to do the right thing and fix it so I wanted to do the right thing and not spend stupid money to fix a small dent. Total cost, $100.00.

When I bought my 2000 Dakota, a screw had somehow stuck up and damaged the hood when closed. A new hood would not come painted or they could repaint the old hood. The fact that someone bashed in my rad fins, standing on the bumper was also not appreciated. Anyway, I elected to just have a record made of it and put a dab of touch up paint on it. I valued the OEM paint on the hood, more then I disliked that little blemish.

In my 20's I had nearly the same thing happen to me. Driving near a local golf course owned by the Knights or Lions or whatever. Hole on the side was parallel, but right next to the road. Driving my very first new truck, a golf ball hit my windshield. It didn't break it, but left a weird waffle like print in it. I pulled over and approached the golfer, a lady probably in her 60's. When I mentioned that she hit my truck and should be more careful, the whole group of them started shouting at me. The lady began berating me for driving on the public road. She told me it was my fault and I took the risk by driving past a golf course.

I was young and frankly shocked by these evil old ladies, so I shut my mouth and left. There was no damage, but it could have been worse (like a motorcycle or bike).

OP - for your sanity, have your insurance company do the leg work and just get the truck fixed.

I'm guessing the golf course itself is not at fault, the person that hit the ball is the at-fault party. Give that person's name to your insurance company and they can go after that person after they pay to have your truck repaired.

The golf course is primarily responsible because it was foreseeable to them that a golf ball would get off the course it it's a the OP described. Of course the person who struck the ball is also partly liable. Small Claims Court and sue them both.
