Everyone is innocent until proven guilty in the US justice system.

That said, some cases seem more apparent than others per guilt or innocence.

I wouldn't expect the legal system to incarcerate a man only on my opinion.

However, I'm certain the reality is in murder cases (for better or worse) some get looked at more thorough than others as far as where the leads may take you (or come to a dead end). On the stupid scale, this guy should be looked at for a long time even if the leads up come up dead. The added reality is (and I honestly don't know but guessing) is that since for the time being the cops don't have any hard evidence other than stupidty, they didn't want to press charges so soon.

I do believe that stupidty isn't a automatic get out of free jail card.

Agree with you sir. Being stupid does not let someone skate.

But I do not think he is stupid....unless extremely stupid. He had his kids in the house. It takes a special kind of stupid to shoot in that situation.

I suspect the guy might have expected the break-ins, for reasons not revealed to LEOs or the press.

Why else might a guy be sure enough that the earlier attempt would be repeated and fire off in the dark.

I'd bet something else was in the house besides the wife and kids.

"Trial by public in the court of missing information" can be expected anymore.

I've worked as rural as living in a trailer in WV and also worked in Washington DC having to take the subway to work. Pretty much every in between in the North East and NC for the last 18 years.

Also I have no clue why anyone would live in Michigan (sorry, rather in communist state of NY which I moved away from), could you please explain why that is such as foolish question?

Do you sincerely believe that Michigan has the upper hand in stupidity or crime per people living there?

No matter where you live you have stupid people and crime.

EDIT - after looking at the area, I do wonder why such a high percentage of blacks so far in the middle of the US with cold weather, but no different that the first time I was in Syracuse I guess. Perhaps Canadian?

This occurred very nearby to me. It is definitely a neighborhood with a long pattern of high crime, but was/is slowly starting to improve.

To say "A home NOT being broken into is the exception there, not the rule." like LD said is quite an exaggeration, yet it is very believable that any given resident there could have been on high alert for a break-in. That said, his story is garbage and we'll have to see how this plays out.

Let's please remember the two young kids who just lost their mother. Tragic.

In this case it was an accidental discharge when cleaning the gun.

Accidently had it loaded.
Accidently had round chambered.
Accidently had safety off. (granted, maybe no safety)
Accidently had it pointed at wife.
Accidently pulled trigger (..but defense is looking into whether gun "malfunctioned".)

Thing that I find amazing, and perhaps it's just me, but ANYTIME I'm cleaning a gun, the gun is unloded. Added the story stated he was cleaning a gun for hunting, but it was a 9mm pistol. Don't know what you really hunt per game animals with a 9mm pistol.

I keep checking for updates, but haven't seen anything yet.

I'd guess the police are going to dot every i and cross every t before (if) they bring any charges. I'd also guess they don't consider him a flight risk for whatever reason as well (with 2 kids, family and guessing a job). Keep tabs on him and let him burry his wife for their children would be another guess. Keep in mind, I have no clue:D

Not uncommon for someone not thinking straight to drop mag and not realize there is still a round in chamber. I watched an acquaintance "clear" a gun before handing it to me. He ejected the round in the chamber and then dropped the mag. Handed it to me "unloaded". He almost crapped himself when I ejected the new round in chamber from the unloaded gun.

We had a similar case (accidentally shot wife when cleaning gun) and the guy finally pleaded. I don't recall final outcome but many still think it was murder since they had issues and he had threatened his wife in the weeks before the shooting.

Legal hours of hunting time 11/17/19 according to Mich hunting guide is 6:55 am to 5:38 pm so it was legal within Michigan hunting hours.IMHO stupid hunting accident no mater what time of the day.
