Woke up about 6 this am, lightning strike nearby. Power went out, just came back on. Not much plans outside, supposed to storm most of the day.

Good Morning. 0935, partly cloudy, 84F with 72% humidity. High of 90F with 30% chance of thunderstorm this afternoon, and a low of 70F tonight.

My grand niece is here from Denver for 3 weeks. Her and mamma came over to be entertained this morning. I gave them oatmeal for breakfast and let her try to play with the wild farm cats. Today is my housecleaning day, so I was doing that at the same time. I also have to pick the purple hull peas then spray them. The bugs are already eating them before I get the first pot cooked.



65ー with heavy rain and thunder this morning. Heading to 81ー with continued thunderstorms all day. Red skies this morning.

Hope it clears as I have to pick up the new King mattress this morning.
Off to town, breakfast with wife, Hd, errands, and pick up mattress.

My duty in the Hall Of Justice is over. Defendant found guilty on three of four counts. I think justice was done, but I doubt anyone involved is going to live happily ever after. Overall, it's a sad story of domestic violence that plays out many times over and everywhere I suppose.

A 24 (female) and 25 year old (male defendant) couple, never married to each other. Off and on relationship since she was 15. Had her first child at age 16--which now lives with the biological father/ex-husband. She has two other young children who live with her. None of the children are the defendant's biological children. At the time of the incident, they were living in and between friends' homes, neither had a job. It sounded like their only source of income was the TANF funds she received for the two young children living with her.

The victim may have been 24-years-old, but I put her level of maturity at about that of a 16-17 year-old. That's a difficult judgment to make just from watching someone testify, but that's the way she seemed to me. The defendant did not testify, so it was hard to get much of a picture him. They played portions of his police interview video in which he was raving, admitting some things, and threatening some things. Not the kind of guy you would want your daughter hanging with. The defense lawyer did not play any portion of that interview as evidence, so I guess there was nothing good to show there.

I assume there was a lot more going on their relationship and lifestyle than what was presented in court. Some of the behavior would lead one to suspect that alcohol/substance abuse played a role.

Criminal assault charge related to two black eyes, a split lip and some choking marks on the neck. The police pics entered into evidence made that a no-brainer. Guilty.

Criminal assault with a dangerous weapon (12 oz claw hammer). The defendant admitted throwing the hammer at or toward the victim in a fit of rage, police photo of hole in the drywall. Guilty.

Domestic violence terrorizing. We had to talk about this one a while as terrorizing does not require an actual criminal act to be committed. A plausible threat under the existing circumstances that bodily harm could occur is all that is necessary. Plausible and circumstances leave room for discussion of course. Guilty.

Terrorizing. A threat made to the victim that her mother's throat would be slit, and her body buried in the backyard so deep her husband would never find her. Not guilty. The defendant did not own a tractor, and I doubt he ever worked as hard in his life as what would be needed to bury the mother that deep. :D

I must say the jury was comprised of nice, sensible folks. Some young, some middle-aged, some old(er) ahem. About 50-50 male-female. All in all, it was an interesting experience.

Dave, nice writeup. Sadly I wonder how long that woman beater will be off the streets and what will happen when he's back...

very hot day today, heat warnings out, glad to stay in the a/c, though I'm headed out for pizza with friends. Got my bags packed and headed back at 5am tomorrow to NC.
and for once remembered my sweat band. Another Hampton Inn adventure, except this one won't be as nice. Actually if the shower is clean and the bed is clean and the wifi works, well, I'm easy to please. This time I will be in Washington NC, close to the house I am interested in. Which thank you Google Maps is seven minutes from the local hospital. And ten minutes from a Walmart Supercenter and eleven minutes to Lowes. And about the same to the Kubota dealer in town. Looking good so far.

Back on the net. After a storm, I couldn't get on for a couple hours. Lots of rain in a hurry here, this will keep the skeeters going for a bit! :(

Dave, interesting day for you. It's sad that so many folks live in a fog of substance abuse and insecurity. Those kids will have a hard breaking that pattern. It is normal for them, as sad as that is.

I'd rate the time to the bota dealer higher than the hospital. I never want to go to the hospital...:)

Thanks Drew. It is saddening more than anything, to learn the details of some very screwed-up lives. The future does not look encouraging for either of them. I don't know his prior record which would influence his sentencing. I didn't want to prejudice myself by Googling him before the trial. The list of charges we dealt with were reduced from the original charges presented during jury selection, so maybe his legal journey is not finished yet.

It isn't a one-sided thing. The young woman was shacked up before her bruises healed--with her two kids at her mother's place no less--for three weeks with another young man. He was called to testify by the defense mostly to get that in front of the jury. He said he didn't know the details of what happened because he was incarcerated at the time of the incident. Not the kind of girl you would want your son hanging with either. She has serious issues that aren't going to be helped by locking up the guy who beat her.

Well, on to happier subjects. Good luck on your exploratory trip to NC. Don't forget your boots and snake bite kit. :laughing: Seriously, take your time finding the 'right' place.

Dave1949, THANK YOU for your jury experience and for sharing the story with us....it always makes me sad that a court has to intervene with domestic issues that should have and could have been settled by the parties involved...so many court cases seem to happen because people are not willing to work things out and want to air dirty laundry in public. But...my opinion is biased...I don't know the entire story, I don't know either plaintiff or defendant, I don't know a lot of things about the case...and even those who served on the jury like yourself cannot know themselves...so many factors involved and it must be hard to make a rational decision...I truthfully admire those who can deal with it day in and day out....

Enough babble....was out on my tractor about 3 pm and saw a really severe storm heading toward me, put up a pic on Facebook and said "TAKE COVER EVERYBODY...." the sky here to the west is always open and visible so severe weather is easy to see when it heads this way...rain came down in torrents again, about 1 1/2" in ten minutes. Going to sit down and shut up for a while...LIFE IS GOOD !!!
