Im sure most of you wont agree especially car doc but this first paragragh explains why it.escalated so much. IMO for what its worth

I have the right to drink on my property as well!

fwtw I am licensed to carry a concealed weapon and have been a competitive pistol shooter for over 20 years I could have hit the dog at any place on my 1 1/2 acres had I needed to but I ran to within 20-30 feet and saw I could take a shot to scare him w/o hurting anything up to that point he wasn't reactive to any type of diversion to get him out of the yard that we did anyway. \

And dont forget I said the horses were already caught which I did help with btw and they were headed down the road when the dog came back in the yard and started his chasing one of my outside cats it was almost over but he saw a cat and went after it just like I feared he would up until that point the cats were hiding probably just guessing.

I had just got home and like I always do I go out and sit and drink a beer and relax by the pond hadn't been there 10 minutes there wasn't anything being planned in my mind or wasn't drunk at all just sitting and enjoying the peace and quiet with my wife and my favorite cat.

Who he is a 12 year old house cat that is hard of hearing and he cant see well he knows nothing about dogs and he couldn't see it or hear it coming either thats where I got momma griz on the dog we told them get that dog on a rope over and over or he will get shot.

They encroached on me trying to catch the horses that is it. I sure as **** didn't bring anything on I was just minding my business they wouldn't control the dog that was their decision to ignore the warnings.

That was them that escalated the situation I may have been able and willing to help catch the horses better if I hadn't been preoccupied with the dog but they didn't cooperate with my concerns that is where it went bad.

In the end, I commend CarDoc for not shooting a dog that really didn't deserve it, but at the same time am a bit curious as to why the situation had to be so confrontational to start with.

That's what I believed was the correct solution even as aggravated as I was shooting something was only a last resort I tried and tried to get him out of a situation I knew could get ugly.

The situation started getting maddening (or confrontational to use your words) when I started talking to the clown he is a complete idiot I know him very well and just could not get it thru his head they needed to get the dog out of my yard the horses were not a worry other than they ended up in my garden stomping on and eating my corn which is bad enough imo.

All he could say was one of the horses was his and the dog goes with the horses and on and on like that meant something to anyone but him.

I'm with Car Doc on this. 1) I don't trust unfamiliar dogs, especially ones running around wildly on my own property; 2) You obviously have history with this bad neighbor, so the time for "benefit of the doubt" is past; 3) Some posters don't seem to understand you wanted to defend your aging cat; I see nothing wrong with that. Why should you let your cat be injured or die because some a-hole won't get his d@mn dog under control, especially after repeated warnings about it. And, if the dog ran into your back yard, whereas the horse is in the front yard, then "the dog goes with the horse" is false; It goes maybe somewhere near the horse ... which is irrelevant anyway ... the horse wasn't going to possibly chew up the cat.

Thanks bep you see it exactly like I wrote it and in the spirit it was meant to be understood.

The sheriffs deputy saw nothing wrong with my feelings either.

And if someone wonders why my wife didn't get the cat its because she was in the opening in our FENCE they went thru so they couldn't get back INTO the yard where the cat was the dog was another story.

See...this thread is a perfect example of how things can go wrong in cyber space....

So much is lost in an effort to tell a story using a keyboard minus body language and all that goes with it..

As it turns out there is a history with this neighbor and that is why Car Doc referred to him as a Clown...all makes sense..I think we all have to keep in mind that these postings are only partial communication...not like we are all face to face and able to talk back and forth ..we just have to make allowances....Just my 2 cents.

I know I love my Dog and no matter the circumstance before I let anything attack it I would intervene.

He describes it as a house cat. It's right there in the name. I fear he may have a heart attack if a hawk comes by.

I'm not concerned with you or Car Doc. I suspect the cops felt is was the best choice because they saw how unstable he was over such a petty incident.

1.5 acres is a small lot. Very small in a rural area.

You take care of your animals your way and I will do them my way its only right for the animals in question he is mainly a house cat except when I let him go with me outside then he is where he is on purpose.

The law was out on the road already when I see them in my yard they called the clown in to catch the horses he has about 20 that are always out another story there 2 dead horses and one person in very critical condition...

and I have no idea who called them could have been them or someone driving down the busy highway they live next too it wasn't me except when I wanted her to call 911 right when I saw all this in my yard and then the clown says they are here already I didn't see them until we all got next door where my garden is.

A small lot I may have @ 1 1/2 acres its actually the 2nd biggest lot on my block but be that as it may be I sure wouldn't put a bunch of horses on it like these people do on these .5a lots I refer to and then expect them to exercise etc on other peoples property or next to a busy highway like where these lived thats insane stupidity.

Plus the county hasn't adopted the zoning to stop it we are actually in the 3 mile zone not in the county not in the city. Its a nightmare for all of us we are in a rural residential area 2 miles out of city limits that was re-zoned to allow livestock unbeknownst to anyone in the subdivision when they did it that it would turn out like it has.

And dont get me wrong they have the "right" to do it it doesn't make sense from any angle of animal care custody and control but lots of laws are found to be flawed after the fact its just the way it is for now.

All these "people" starting little ranches next to the rest of us who hope someday to sell at a profit since we are making improvements on our property's no one can sell anything i the "ranch" part of the sub-division they move in and the place is a feedlot and we still pay the high taxs.

It was rezoned to light commercial for some reason and that allows livestock and thats why we are fighting the zoning to restrict large animals on these small property's and thats another reason anyone would call the law. There is strength in numbers the law here is sick of being cowboys they cant even charge these people for anything so why would they change their behavior and the more calls in to dispatch the more we all stand a chance of changing something.

For those who dont have the same issues truthfully are making their case to someone else being in the wrong need to try walking in those shoes and then come on here and speak with experience otherwise shut the **** up.

As far as escalating the situation well that could be said of almost any situation I choose to defend my self and my property and I have the right to do so I wont lay down for anyone and let them walk over me.

Like I mentioned we have a serious problem in my area with horses and cattle running loose a long time running we ALL are tired of it!!!

Its not a dairy or a bunch of friendly neighbors with errant critters or nobody would care its a class of people who abuse animals and exploit them at the local horse race track 10 miles out in the county on private property does that clear anything up?

Well I don't have a dog in this race ... but when I asked how many bad neighbors you had I was only wondering about the neighborhood.

I have sold many 2-10 acre lots in subdivisions with restrictions ... restrictions by the seller of the lots ... Someone like CarDoc buys his with the idea of a sweet little homestead, pond, garden ... oh the wonderfull life AND THEN BANG a bunch of clowns join the circus.

Clown is lucky that the dog was not on my property messing with any animal I have, cat(s) dogs, cows, calves, mules, horse's, chickens, pigs. I would not fire a warning shot.

I like CarDoc own my property and I will do on my place as I see fit ... including consuming as much beverage as I want, when I want and I have been known to pee off my porch!!!

I am fortunate and have good neighbors ... we all feel the same about our dogs ... if my dog wondered over and chased my neighbors cat or anything I would expect them to handle it ... and they know I will do the same.

Now livestock is a different matter, fences do get holes and animals do get out ... when this happens we call each other and help each other put them back where they belong.

BTW ... the law has never been to my place nor have the neighbors or myself ever called them, we just talk things out.

Well, I feel a person has a right to be left alone on his own property. It sounds like the guy with the horses and dog had more than he could handle and they got out of control. If I were at home and all that went on...I would feel like they descended on me and all was out of control. It would have made me mad, too. But, sometimes accidents happen.

I would have helped get them rounded up, (no choice with that), and sternly tell the guy not to let it happen again. At least some boundaries would be established for sure, then. If it had happened before...then I would REALLY have been mad. I like dogs...but if the dog would have attacked my cat I would have to use deadly force.

When you live in an area that is neither true country nor true city the lines are blurred and the cowboys with 2 acre lots have to ride their horses and atv's all over someone else's land. They will do what they can get away with...knowing full well what they are doing. It's called self centered and lack of manners.

My place is fenced and gated. That's my suggestion for you too, Car Doc. Fences make good neighbors. It has been worth every penny. You have the right to be left alone.

About a year ago I hear my chickens making a racket and immediately after the chickens squacking I hear my wife is yelling for me "A dog's got a chicken!" I grabbed a gun and ran outside and there's a beagle with a mouth full of feathers running hellbent for the driveway and off the property. I had a bead on the dog as it headed for the driveway.. didn't pull the trigger, but was ready to. I love animals we have many (4 horses, 4 sheep, 14 chickens, 2outdoor half wild cats and 3 indoor cats.. so far.)

The dog was a beagle, (they're impossible to handle off a leash.. I owned one years ago.. never again.)

The point is this is my land and a strange animal was injuring one of my animals...still.. I woulda felt very bad if I had shot the dog, thank God I did not.

We found out who owned the dog and walked over and spoke with her.. She didn't know the dog had got away.. She felt terrible that her animal had hurt one of ours. It hasn't been back since.. another sad thing is the dog spends all his time in one of those kennel cages, so when it gets out it's play time.

No I won't shot if the dog comes back, I feel sorry it has to spend all it's life in a cage.

My first response was to stop the threat.. after I cooled off and learned more my heart went out to the dog. It didn't do anything to be mean, it just was having fun for once. The chicken wasn't hurt badly, no teeth marks, just a few feather pulled out.

If it was a mean dog and it went after one of my wife's pet animals, or had killed the chicken, the outcome could be different. I want to be a good neighbor, but.. there is a limit to good neighbor vs someone taking advantage of me.

If it was loose horses there would be no problem from me.. I woulda caught em and put em in my pasture until the owner came or I found out who owned them.
